澎湖海上平台法律課題初探

A Preliminary Study of the Legal Issues in Penghu's Offshore Platforms

摘要

澎湖「海上平台」休閒漁業，或稱作觀光漁場、海洋休閒牧場等，是以箱網養殖為基礎，逐步發展出體驗式的休閒漁業活動。2008年，澎湖縣政府公告「澎湖縣海上平台管理自治條例」，隨即公告「澎湖縣海上平台審查作業辦法」，規範海上平台的申請籌設流程、經營管理及罰則等。這些規定賦予澎湖海上平台，從無法可管與非法營業的處境，過渡到「合法化」的途徑，以及地方政府做初步管理的機制。然而，在澎湖海上平台深受觀光客喜愛的同時，衍生的海洋污染、占用海域，引來當地漁民抗議等，這些牽涉漁業權與海洋污染等問題，均顯現地方法規之不足以及地方執法上的問題。本研究即初步探討澎湖海上平台的法律課題，包括：漁業權、海洋污染、保險、載客船舶的適法性等問題，並提出建議。

Penghu's ＂offshore platforms＂, based on cage aquaculture, has been developed as recreational fishing activities.＂Penghu's offshore platform management ordinance＂ and＂ Penghu's offshore platforms review procedural regulation＂ were announced by Penghu county government in 2008 to regulate the establishment and applications, operation and management, and violation fines and penalties for offshore platforms. These regulations provide offshore platforms with a legal foundation for the transition from illegal businesses to lawful conditions and provide local government with a preliminary management scheme for the platforms. These offshore platforms welcomed by tourists have caused marine pollution and sea space occupancy that draw protests led by local fishermen on the issues of fishing right and marine pollution. These demonstrate the deficiencies in local regulations and law enforcement. This study addresses the legal issues of Penghu's offshore platforms in the perspectives of fishing right, marine pollution, insurance, and the legality of passenger boats. The recommendations on offshore platforms regulations and management are then provided.
