摘要

值此瞬息萬變之知識經濟時代，以智慧財產（專利、商標、營業秘密等）為核心的新創企業或個人，因智財權的獨特性與固有的價值影響因素，增加其進行證券化的複雜性與困難度。臺灣可參考海外近幾年興起且蓬勃發展的「智慧財產權證券化」成功經驗，以為臺灣推動智慧財產權證券化之借鑒。本文先對智慧財產權證券化作功能分析、流程分析、特殊性分析，再對智慧財產權證券化供給方（創始機構、仲介機構）及需求方（投資者），以問卷方式做意願分析，再分析臺灣實施智慧財產權證券化之可行性、障礙性、海外各項經驗借鑒（如：鑒價、法制基礎、適格資產、將來債權移轉及資產移轉是否真實、管理模式等等問題）；而後再對各項分析提出推行臺灣智慧財產權證券化實施條件之相關建議。希冀能藉由本文之探討，對臺灣將來發展智慧財產證券化有些許幫助及幫助。若能成功推展此種新興的金融商品，相信對臺灣金融市場的效率與自由化有正面評價，更能增加臺灣在國際金融上的知名度。
