摘要

本文以加拿大「政策與立法的性別基礎分析」為基礎，先行解析何謂社會性別基礎分析，並對我國國民體育法政策做歷史性及批判性的解析。我國目前國民體育法政策及實施過程較缺乏社會如何建構性別的觀點；也較缺乏具社會性別分析的相關研究；政策未將男性、女性、男孩、女孩都明列進去，只籠統以整體為對象，較少不同性別、年齡、階級與種族的分析。本研究發現制訂法令的群體並未完全瞭解社會性別主流化的概念，政策的擬定是否對男女公平或其意義缺乏深入考量，導致政策制訂或頒佈時有意或無意傷害性別平等的發展。我國行政單位應配合聯合國最新工作模式「將社會性別分析融入主流政策」，未來所有健康政策在計畫、執行及評估過程中，應進行性別影響評估，並有兩性共同參與。

This article examines Canada's attempt to define gender-based analysis with regard to gender-based analyses of legislation and policies and examines the implementation of the National Sports Act in Taiwan from historical and critical perspectives. Taiwan's National Sports Act currently lacks a gender-based perspective. Related research on gender analysis also remains inadequate in Taiwan. Terms such as ”women” and ”men”, rather than being specified in the Act, have been avoided in preference of using terms that do not define gender. Furthermore, implementation has also been carried out without considering age, socioeconomic status or ethnicity. Our analysis found that policymaking groups do not completely comprehend the concept of gender mainstreaming, fair treatment to different genders and the implications of policies are not well-considered. Such failings may, consciously or unconsciously, damage the healthy development of gender groups in Taiwan. The government in Taiwan should adopt the new working mode adopted by the United Nations and mainstream a gender perspective across all health policies in each stage of development (e.g., planning, implementation and evaluation). Women and men should fully participate in health decision-making and all sectors of government.
