從中國大陸律師之辯護保障權探討對司法制度之影響
The Influence of Juridical System Viewing from the Defensive Protection's Right of the PRC's Lawyer System
摘要
中國大陸律師制度是國家整個司法制度中之重要組成部分，是依照掌握國家政權階級的意志所建立起來，並為該階級的經濟和政治服務，而有無律師制度以及律師制度是否完備，將是判斷中國大陸民主是否健全，法制是否完備的一個標誌。而大陸辯護制度作爲刑事訴訟制度的重要組成部分，在司法制度中佔有重要地位，其完善與否，是衡量大陸刑事訴訟制度乃至整個司法制度科學、民主程度的重要標誌。 本文希望藉由中國大陸律師制度中之辯護保障權來探討對於司法制度之影響分析，藉由律師制度探討，包括律師制度之建立與發展，就律師之辯護保障權，來探討對於中國大陸司法制度之影響，進而觀察中國大陸司法制度之現況與未來發展。

The PRC's lawyer system is the most important part of the PRC juridical system. The PRC's lawyer system is good or not, and it will influence the democracy of PRC. And Defensive Right is also an important part of the PRC juridical system. This article is mainly discussing the defensive right in the PRC's lawyer system, and discussing the influence of the defensive right. In addition, I want to observe the situation in PRC's juridical system.
