中國「東海防空識別區」的法理分析

2013年11月,中國宣布「東海防空識別區」,引起各方強烈關注。防空識別區不是領空,更非領空的對外延伸,純粹是各國基於本身國家安全的一種宣示,特別是此一區域涵蓋釣魚台上空,被認為是中國展現武力和準備對日強硬的表示。面對中國逐漸借用國際法概念,台灣交戰規則的制訂,雖無參與國際聯盟或境外軍事行動的急迫性,但我國在空域權利行使上,仍有「臺灣防空識別區」的設置,空軍飛行員如何在防空識別區下準確行使空域軍事行動,更需未雨綢繆予以規劃。

In November 2013, Chinese government has declared its Air Defense Identification Zone (ADIZ) that drew the international attention. Legally speaking, ADIZ is not equal to territorial airspace, nor is it equivalent to the extension of airspace. Instead, it symbolizes nothing more than a political manifestation for the sake of national security interests. The Chinese ADIZ, which intentionally covers the airspace above "Diaoyutai /Senkaku Islands" is regarded as the political demonstration against the Japanese government. Given the growing tension above the land in East Asian, although Taiwan has also declares its ADIZ, how to accurately exercise all military actions by air force in Taiwan's airspace becomes one of the priorities that Taiwan must deal with before it becomes too late.
