摘要
本文旨在探討二○○八年下半年，法國擔任歐盟輪值主席期間所取得之成就。歐盟在整合（integration）過程之中，有諸多前所未見之創新做法值得吾人深入研究。全文共分為六部份。【壹】、前言：研究議題之重點和特質分析。【貳】、歐盟為了追尋永久的政治和平和經濟繁榮，所發展出來的組織特質，尤其是利用「談判」取代戰爭的運作機制。【參】、從歐峰會對歐盟發展之重要性分析歐盟輪值主席之緣起、歷史發展、法律地位、權力、以及對歐盟整合之影響。【肆】、評析此次法國擔任歐盟輪值主席期間所提出的各項議程、政策目標和所取得之成果。【伍】、分析法國擔任歐盟輪值主席期間所遭遇到的問題和挑戰，探討哪些是已經解決的問題？哪些是尚未解決的問題？以及繼法國之後，捷克擔任歐盟輪值主席所可能遭遇到的問題。【陸】、本文之研究心得和發現，尤其是歐盟輪值主席制度之優缺點，和法國擔任歐盟輪值主席期間，積極尋求「一致決」（consensus）的經驗和作法。

This article scrutinizes the France's EU presidency in 2008. The development, the legal basis, and the presidency of the European Council have been analyzed in detail. The EU is a ”sui generis” entity and walks a thin line between intergovernmentalism and supranationalism. It aims to achieve integration through negotiations instead of military actions. The permanent conflicts of interests between EU member states require both exceptional solutions and innovative institutional design. The European Council is a good example. Attended by the heads of state and heads of government, the European Council is the most powerful engine behind the EU. The results of the French EU Presidency during the second half of 2008, illustrates clearly the innovative role of this organization. The initial agenda and unexpected achievements have been successfully accomplished during the French EU Presidency. The tactful leadership and consensual diplomacy deployed by the dynamic French president Nicolas Sarkozy are indispensable for the management of crises, who has given the EU and France more ”visibility” on the world stage. This study will highlight some specific methods to obtain ”consensual solution” during the French EU presidency. Many French innovative methods can be inspiring both for our theoretical research and practical applications. After France, the Czech Republic will preside over the EU for another six months. It's predictable that new challenges and controversial issues will once again incite the EU to find more innovative solutions.
