「保險是騙人的」-壽險業污名形成之制度因素

"Insurance is Discredited": Institutional Factors of the Formation of the Life Insurance Industry Stigma

摘要


本文的目的是透過論證壽險業污名形成之制度因素,來說明污名的形成與社會制度之間的關連性。本文不同意Goffman將任何差異都視為污名屬性的可能性。本文主張某個差異之所以是污名屬性必須從制度層面加以論證。任何污名屬性皆是透過持續不斷地社會互動去獲得一次又一次的確認,而讓社會互動能夠持續不斷地出現必定是某種超越個人與組織之制度。以壽險業污名為例,壽險業污名的內涵即民眾認定「保險是騙人的」,但「人情保」之所以會衍生出保險糾紛致使民眾產生「保險是騙人的」印象,是因為國家同意壽險公司利用沒有法律地位的「保險業務員」去招攬業務,亦同意壽險公司藉口保險法第64條盡可能拒賠的作法所致。

This article explains the relationship between the respective formations of stigmas and social institutions by demonstrating the development of the life insurance industry stigma. Goffman argued that any difference in the formation of a stigma may be considered a stigmatized attribute. However, the author of the current study is skeptical. A difference in the development of a stigma must be proven as a stigmatized attribute by institutional research. Any stigmatized attribute is accepted as fact through continued social interactions, and repeated social interactions inevitably become a type of institution that transcends persons and organizations. By considering the life insurance industry stigma as an example, this article argues that people believe that insurance is discredited because the government in Taiwan allows life insurance companies to take advantage of insurance solicitors who are not legally licensed to sell insurance, and because the government in Taiwan enables life insurance companies to abuse the right to deny claims by citing Article 64 of the Insurance Act.
