摘要

當長期照護相關政策實施多年後，近兩年來政府致力於長期照護保險法之立法規劃與宣導。考量德國社會立法之歷史與經驗，儘管其長期照護保險制度僅實施近十六年，不斷修法中仍有缺失，但該法規範內容完整且體系化，對於繼受德國法之我國，於此推動立法之際頗有參考價值。本文首先說明長期照護保險法立法之憲法基礎，其次介紹德國長期照護保險法之立法背景、內容、現存問題與因應之道，最後從德國經驗建議我國立法宜有之方向。

The Taiwanese government has dealt with the issue of long term care insurance for several years now, and during the past year, the focus has been on its judicial matters. The social legislation in Germany has proven reliable in many aspects, and although it has been introduced only 16 years ago and several unsolved problems remain, its contents is in most parts well-structured, systematic and carries a reliable concept. Since Taiwan is a country with a legislation oriented towards the German legislative system, it is worthwhile from its perspective to get to know the German long-term care insurance system in detail.Therefore, in the present composition, the constitutional motivation of the long-term care insurance legislation is described at first. Furthermore, the origin, contents, and solution of the well-known problems in the German long-term care insurance system are summarised. Finally, a new Taiwanese long-term care insurance draft idea is suggested.
