戰後檔案管理的國際法規範與國內法實踐
The Scope of International Law and Domestic Law Practice of Postwar File Management
摘要
二次世界大戰以後，臺灣從日本殖民地轉而成為中華民國政府轉進的根據地，前前後後歷經了許多內外情勢的挑戰，最終獲致今日美好的民主成就，而這段從威權轉型為民主的歷程，隨著戒嚴二十週年，政府舉辦一系列的紀念活動，漸次受到社會各界所重視。檔案存在的意義即在這裡，這些戰後的檔案，不僅能夠還原歷史的真相，更能拼湊屬於這塊土地共同的回憶，使記憶的拼圖能夠歸於完整。本文在研析過檔案的法律性質，確認檔案係公物而為國家主權之延伸後，先試圖由國際法的角度切入，探究國際間檔案回歸之實踐，析論國家在檔案散落於各國而欲要求返還時所得依循之國際法規範與相關原理原則。次則透過各國就檔案內國立法之比較，檢視我國檔案相關法制以及重要檔案移轉之案例。

After World War II, Taiwan had been transferred Japanese colony into the counteroffensive base of Republic of China and made a democratic achievement under suffering from a great deal of internal and external challenges. Furthermore, the process of democratic development was set store by the public gradually via a series of commemorative activities about the twentieth anniversary of martial law. With regard to the significance of the existence of files, not only could these post-war documents restore the historical truth, but put pieces of common memories of the land together to complete the fact puzzle.This thesis tries to discuss the international rules and principle on national files. Firstly, it researches and analyzes the legal nature of the files in order to confirm the national files are public properties as well as the extension of national sovereignty. Secondly, it examines the practice of returning international files and relevant regulations under the scope of international law. Lastly, by comparing with variety of national file legislations of different countries, the thesis will review Taiwan's legal system and important cases about transnational file transference.
