我國菸害防制法關於「吸菸場所限制」之合憲性問題探討

摘要

自民國九十八年一月十一日起施行之現行菸害防制法係為符合國際菸草管制框架公約而修訂。該法大幅擴張對於「吸菸場所限制」之規定，吸菸者能否主張其「吸菸自由」、「吸菸權」？系爭規定有無侵害人民之相關基本權？本文首由菸草使用及菸草管制之變遷角度切入瞭解菸與人之關係，次針對我國菸草管制之沿革進行介紹、比較，並提出各該規範可能會對人民基本權產生之影響。關於「吸菸場所限制」之相關規定，本文先參考美國、德國立法例禁菸令所受之憲法挑戰，再回到我國系爭規範分別由下列角度切入：吸菸者與不吸菸者之健康權、吸菸者人性尊嚴與不吸菸者之健康權、場所管理人之工作權及財產權，探討新修菸害防制法「吸菸場所限制」規定之合憲性。主張現行菸害防制法「吸菸場所限制」之規定除侵害吸菸者之健康權與人性尊嚴、場所管理人之工作權，對於非吸菸者健康權之保護亦有不足之疑義。最後對現行新修菸害防制法提出執行上產生的問題，並提出修法建議。

On January 23, 2009, Taiwan enacted the new Tobacco Hazards Prevention Act. To protect people away from exposure to environmental tobacco smoke (ETS) the new Act bans smoking in most public spaces. This smoking bans were unconstitutional for infringing on smokers’ rights of Health and liberty. The regulation has not interfered with the business owners economical viable use of their shops, but it was unconstitutional for infringing on their freedom of business.Clearly this new Act need reviseing.
Chapter One of this paper shows four dimensions of the tobacco control. Chapter Two looks though tobacco use history and its regulation history. Chapter Three reviews Taiwan’s tobacco control polacies and conpares the previous smoking bans and the new ones in Tobacco Hazards Prevention Act. Chapter Four explores the constitutional challenges on smoking bans in both USA and Germany. Chapter Five examines constitutional challenges on the newly acted smoking bans in Taiwan. Finally, Chapter Six summarizes the findings, suggests some possible developments for smoking bans in Tobacco Hazards Prevention Act.
