台灣政黨法制之研究

摘要

本文之研究要旨主要在於政黨相關法制之研究與說明，而政黨法制具有高度政治性質，故必須先從政治上對政黨做理解，近代民主國家政治發展，幾乎與政黨政治發展畫上等號，政黨與政黨制度雖係民主政治下的產物，卻同時也是民主政治重要的推手，首先透過單一政黨概念的了解，我們可以知悉政黨在近代民主政治下所被賦予的定義與功能，以及在一個以上的政黨間之互動關係，所形塑出的政黨體系，亦可得知一國之政黨政治運作情況。
肯認政黨中介性質功能之重要性後，便進入政黨法制之法理基礎探討，透過這些抽象化的法理基礎概念，讓我們了解政黨之核心內涵，以及必須予以法制化的原因，此外，本文另一發展脈絡便係透過歷史方式，介紹台灣政黨及政黨法制發展之歷程。接下來便進入政黨法制的研究，說明在〈政黨法〉施行前及施行後的政黨法規範，透過新舊法說明，可以得知適用法規範上的差異及舊法時代待解決的問題是否得到處理，並輔以外國立法例，提供〈政黨法〉之修法建議，另一方面本文也試圖透過立法院會議紀錄，還原政黨法條文形成之折衝過程。

This thesis aims to research and discuss political party legislation in Taiwan.
Political party and political party system are borned by democracy, meanwhile they encourage democratic development, because of the highly-political oriented nature of political party legislation, we need to study on party from the view of politics before we move on to the legislation section.
First, from going through the concept of single party, we learn the meaning and function of party under democratic politics, furthermore, we observe the party system form by interactives between multi-parties, in which it also reveals the operation of party politics under a county.
After recognizing the mediate quality of political parties, the next section discuss on the legal foundation of political party legislation. In this section, from learning abstract concept of legal foundation, we could understand the main connotation of political party and the reason why legalization is the only path to it.
Finally, this thesis points out the differences between the old and new Political Party Laws in Taiwan, and most importantly, the improvements have made by the new Political Party Law and the changes could be made in the future.
