本文係以廉政專責機構尚未成立下,進行政風機構未來如何強化組織與功能之解析。從歷史研究途徑,先觀照我國廉政機制與政風現況分析,梳理我國廉政政策與法規之發展、體系分工、政風機構工作概況,及我國貪瀆現況與遭遇問題之分析。次就「回顧過去」政風機構「推動廉政專責機構遭遇困境」,檢討廉政系統與環境間之衝突,分析我國為何無法設立廉政專責機構之理由。以及「展望未來」在新推動之「國家廉政建設行動方案」上有無新的廉政思維及推動方向。 而從盧曼社會系統研究途徑,參考國際環境中「國際反貪思潮與行動」,借鏡國際組織反貪構想與香港與新加坡之反貪成果,加上政風機構在「廉政系統」及「立法系統」、「公共論域」間之觀察、溝通與行動,經過系統調控後之未來建議。 研究結論發現,政風機構目前在推動廉政建設中,確實存有組織架構、職權受限及人力分配等問題,而從國際組織反貪思潮及行動中,多元廉政策略趨勢已見形成,傳統單純「肅貪」思維、「預防與肅貪」二元思維、甚至「反貪、防貪、肅貪」三管齊下作法,終將成為過去,取而代之的是跨國域、跨領域、跨學門攜手整合的多元廉政策略,而未來廉政重點領域在於廉潔教育紮根、企業反貪自清以及公民自發參與。為迎接未來新興廉政領域,建議政風機構應適時檢討政風機構人員設置條例、增訂職權行使法或廉政作用法,並且最重要的是廉政系統應分工合作、避免內耗,才可能控制貪腐。
The article is dedicated to how the Government Employee Ethics Units (GEEU) strengthens the organization and function if assumed that the Government Integrity Institute (GII) is not established. The writer reviews the mechanism of GII and the GEEU in Taiwan, and work up on the analysis of policies, law development, system division of labor, working profile of GEEU, and current situation and the problems of corruption with the analysis of historical research approach. The writer also tries to review the difficulties of GEEU’s promotion to GII establishment in the past, the conflict between system and environment of GEEU, and analyze why the GII can’t be established in Taiwan. In the end , the writer tries to prospect the future of ‘Nation Action Program for Clean Government’ to consider if there is new thinking model or direction of the GII establishment. The writer refers to ‘International Anti-Corruption Thought and Action" in international environment and learns from international anti-corruption vision and achievements of Hong Kong and Singapore. Besides, the writer tries to analyze the general observation, communication and action of ‘government integrity system’ and ‘legislative system’ and ‘public sphere’ within GEEU, in the end the writer proposes the suggestion with systematical regulation. The writer discovers that there are some problems of GEEU’s organizational framework , and its limits of authority of office and allocation of human resource while GEEU promotes government integrity actions. The plural government integrity strategies has been formed while reviewing the trend of thought and action in international organizations. The traditional ‘curbing corruption’ , ‘prevent corruption’ and ‘curbing corruption’ binary thinking model, or even ‘combat corruption’, ‘prevent corruption’ and ‘curbing corruption’ three approaches model will eventually become the past, replaced by a cross-domain, cross-cutting, interdisciplinary plural integration strategies.The future focus in integrity sphere will be the educational cultivation, enterprise’ anti-corruption action and civil spontaneous participation. For facing the future emerging field of government integrity, the writer recommends the GEEU should be timely review the Act of the Government Employee Ethics Units and Officers, and revise the Authority Performing Act or Government Integrity Act.Most importantly, the government integrity system should work together to avoid friction and then it can control corruption.
