台灣以土地信託 辦理都市更新模式之研究

A Study on the Urban Renewal Model of Using Land Trust in Taiwan

摘要

民國八十五年台灣頒訂「信託法」迄今，國內的建築開發案亦開始採用「土地信託」方式，而這種方式是否可以用來辦理台灣的都市更新事業呢？
本研究從文獻中探討「土地信託」與「都市更新」的意義與理論架構，及台灣的「土地信託」與「都市更新」的法治體系與執行現況，並透過專家問卷，從產官學三方面來了解台灣以「土地信託辦理都市更新」模式運作上的問題與看法，透過「都市更新投資信託公司」的問題整理中，分析以「土地信託辦理都市更新」面臨的課題與策略，從研究日本土地信託的制度與辦理都市再開發的案例，及目前台灣開發商採用土地信託的案例中，整理出四種「土地信託辦理都市更新」的操作模式與架構，最後以台中市「德昌新世界」為案例，進行個案的模擬操作；並提出建議於政策與法制面上應將土地信託明訂於都市更新條例、開放金融機構擔任都市更新實施者、放寬金融機構之投資業務與項目、設立國家都市更新基金、建立不動產鑑價制度與增修訂相關法規及配套制度；在環境與市場面上應廣泛地宣導教育與研討觀摩、建立受益權憑證轉讓市場與建立都市更新保證制度；在執行與整合面上應在各金融機關設置專責科室、放寬金融機構對都市更新事業投資與融資的限制、設立聯合執行的專責窗口與建立完整的信用的評等制度以供政府增修法的參考。

Since Taiwan published the Trust Law in 1996, the national construction development
project also applies the manner of land trust. However, is this manner is suitable to
conduct Taiwan’s urban renewal undertaking?
This research is, from documents, to make a study of the importance and theoretic framework of land trust and urban renewal, and of the legal system of land trust and urban renewal and the present implement situation as well; through the question naire on experts, is to know the operational problem of and people’s attitude towards Taiwan’s Urban Renewal Model of using Land Trust from the angles of industry, government and university; through clearing up the problems of urban renewal investment trust companies, to analyze the subjects and strategies we face if we apply Urban Renewal Model of using Land Trust; by studying Japanese regulations of land trust, Japanese urban renewal cases, and cases of Taiwan developer applying land trust in the present day, to sort out four operating methods and frameworks of Urban Renewal Model of using Land Trust ;and finally taking Taichung City’s Dechang New world as an case, to make simulated operations. In addition, this research proposes suggestions that in the aspect of policy and legal system, the government should clearly and publicly write land trust in urban renewal regulation, should make the financial organs to serve as the implementer of city renewal, loosen or relax restrictions for financial organs on investment business and programs, establish national fund for urban renewal, and set up real estate evaluation system, amendment regulations and matching system; in the aspect of environment and market, the government should widely advocate educating and discussing observations, create market for the transfer of beneficiary right certificate, and establish urban renewal guarantee system; in the aspect of implementation and conformity, government should set functional offices in the financial organ, loosen or relax restrictions for financial organs on investing and financing the urban renewal undertaking, establish joint implementation functional windows, and establish complete and authentic rating system as a reference for the governmental amendment law.
