由於網路服務業者本身並未從事侵權行為,當網路服務使用者侵害他人權益時,網路服務提供者對於其使用者是否應負責一直是個重要的研究問題。美國1998年通過之千禧年著作權法最初的制定即是預防這類網路著作權侵害問題,因此已提供安全港條款方式,讓符合特定條件的網路服務提供者得以主張免責保護,並提供配合著作權人阻止侵權行為的誘因。順應此趨勢發展,我國在2009年4月最新修正通過之著作權法也參考美國之DMCA,制定了第6章之1的網路服務提供者責任限制條款。 因此,本文將介紹美國之著作權侵權責任;DMCA§ 512相關之規定;美國與我國法院具代表性案例之爭議;以及我國最新通過的著作權法修正條文。本文的目的即在於釐清網路服務業者的相關責任,並對我國最新修法提供評論與建議。
The question whether Internet Service Providers (ISPs) should be liable for their service user’s copyright infringement is an important one. The U.S. Digital Millennium Copyright Act of 1998 ("DMCA") was enacted to establish "safe harbor" provisions for ISPs. In the Act, ISPs may be exempted from imfringement liability if they meet certain criteria. The Act also encourages ISPs to cooperate with copyright holders. Learning from the U.S. DMCA, Taiwan’s parliament in April 2009 passed Chapter 6-1 of the Copyright Act providing several liability exemptions for ISPs. In the thesis, we will first examine the U.S. DMCA in great length, including leading cases in U.S. courts. Then, the author gives an introduction to the legislation of liability exemptions for ISPs in Taiwan. At the end, the author provides comments and recommendations for Taiwan’s new legislation from U.S. experience and cases.
