以無線廣播電視頻譜傳送數據服務之管制研究

摘要


數據服務是透過無線廣播電視頻譜傳送非節目類的資訊服務,有別於廣電的節目內容服務。除了提供資訊類服務外,現行各廣電業者亦將數據服務朝向收費服務規劃,同時具有回傳、雙向服務之功能。然就目前的廣電法而言,於法並無法全然規範數據服務,因此,本研究以英國、澳洲對於數據服務之管制規範為研究,以比較規範的研究方法來進行法規面向的比較,試圖發現我國廣電法對數據服務規範可能的疏漏之處。 就英國與澳洲對數據服務之管制而言,英國及澳洲皆設立一數據服務執照來規範業者,並開放予非廣電業者進入廣電市場提供服務。對於數據服務的內容,英國要求比照廣電法對節目內容的要求來處理,並可提供廣告服務,同時無執照期限的限制,但必須遵守頻道服務總量限制的規定;澳洲則是將服務的內容類型分為A類與B類二種,並設立數據傳輸服務執照,分為頻道A(Channel A)與頻道B(Channel B)業者。 參照英國與澳洲之規範,本文發現,我國廣電市場僅拘泥於廣電業者,亦應開放予非廣電業者進入廣電市場以提供數據服務,以豐富廣電市場服務的多樣性,此外,對於數據服務的管制應設立一數據服務執照,並根據廣電業者與非廣電業者之身分,分為第一類數據服務執照業者與第二類數據服務執照業者,執照要求則部分比照廣電法之規範,而付費服務應透過市場接受及淘汰的機制,給予自然發展,涉及電信業務事項者,則應另外申請電信業務執照。然本研究以為,對於數據服務應採低度管制原則,讓其自由發展可能的表現形式,僅對不當內容進行管制,才不至於扼殺多元服務發展的可能性。

Regulation of datacasting service via broadcast bandwith Abstract Different from broadcasting service, datacasting service provides non-program information through broadcasting bandwith. Datacasting service can be a pay service and a service of interactive functions. Our broadcasting regulations, however, contain few provisions for datacasting service. The author aims to study foreign datacasting law in United Kingdom (UK) and Australia and make comparisons with Taiwanese law. As far as datacasting regulations in the UK and Australia are concerned, they provide datacasting service licenses. In addition, the two countries allow the non-broadcasting service providers to enter the datacasting market. In the UK, the content code for broadcasters also apply to datacasting providers. The Australian government classifies datacasting services into two categories, Category A and Category B. The government also plans to establish two kinds of transmission license, Channel A and Channel B. After comparing datacasting regulations of Taiwan with that of UK and Australia, this thesis gives the following suggestions. First, the Taiwan government should allow non-broadcasters to enter the databasting market. Secondly, our datacasting regulation can provide two kinds of licenses, Type I and Type II. While the former is for broadcasting companies, the latter is for non-broadcasting firms. The service providers should follow broadcast regulations with respect to content. The rate for datacasting will be subject to market demand and supply and need not to be regulated. General speaking, it is recommended that a lightly regulatory scheme be for the datacasting service.
