法庭文件翻譯之探討: 以兩件商標案件為例

摘要

法庭文件翻譯涉及許多專業術語及長句，要進行此類文件翻譯，除了要有良好的英文閱讀能力外，尚需足夠程度的法學素養。本譯評收錄了＜可口可樂公司控告純品康納公司案＞及＜杜邦公司控告吉田國際公司案＞兩篇判決，筆者運用研究所課程所學的翻譯技巧翻譯兩篇判決，包括了「歸化」、「等價術語」，並根據賴斯的理論將原文分類成「信息型文本」做翻譯；並討論翻譯過程及所遇問題。本譯評除了針對翻譯過程中值得探討的例句做分析，以說明筆者翻譯的流程、問題處理、翻譯技巧的使用、及用字理由…等外，並針對where一字在不同文中的不同譯法、情態動詞shall及may在法律文件中的翻譯做討論。

As legal translation involves many special terminologies and complicated sentences, it requires not only excellent reading skills in a second language but also sound legal knowledge in order to translate legal texts. Two US court decisions have been chosen and translated into Chinese based on translating skills including Domestication and Legal Equivalent. Moreover, the source texts have been categorized as informative texts according to Reiss’s theory. This thesis also includes reflections on the process of translating these cases and steps taken to solve problems that occurred. This author will discuss how to translate simple terms such as “where” in different contexts, as well as modal verbs “shall” and “may” in legal texts. Furthermore, sentences have been selected from the legal decisions in order to discuss translation difficulties as well as the translation skills needed to translate the texts to the target languages.
