建構臺灣發展智慧型電網之整體法制架構

摘要


摘要 在全球暖化、能源枯竭、供電品質、電力可靠度、電業自由化等議題上,傳統電網已經無法解決災害攻擊、再生能源不穩定供電特性、電動車之能源配置、停電偵測、配電管理、分時電價等高科技電力需求,各國均致力於發展新型態的電網系統。智慧型電網是在發、輸、配、管、用電系統中,應用數位科技及資通訊、電子化技術,整合發電、輸電、配電、調度及用戶的新型態電網系統,提供高可靠度、高品質、高效率及潔淨之電力能源。有鑑於能源政策需要發展完整之「政策」與「法規」才能加以實現。在美國、歐盟等重要國家均已經在法制上建立發展智慧型電網架構之同時,我國發展上則相對缺乏政府總體規劃、投資獎勵誘因、隱私權與資訊安全保護、標準化等規範機制,明顯忽略建構智慧型電網推廣與管制之整體法規架構。本文將介紹美國、歐盟的智慧型電網發展政策及重要法案與措施,希望透過研究比較歐美之整體法規架構,作為國內推動法制建構之啟示,以協助當局加速臺灣智慧型電網法制化之時程與規劃。

Abstract This thesis studies the overall regulatory framework of smart grid development policies and important bills in Europe and America in order to promote the construction and implementation of smart grid law in Taiwan. Raising awareness of environmental protection is a key issue because the world is facing severe problems such as energy shortages, global warming crisis, and the greenhouse effect. The traditional power grid could not catch up with economic and technological pace regarding power quality, power reliability, expansion of transmission and distribution lines, and electricity industry liberalization issues. Thus, many countries have put forward a vision and strategy for the development of new smart grid. Smart Grid is used to promote electronic power infrastructure modernization, and it is the application of ICT (Information and Communication Technologies) in optimizing power generation, transmission, distribution and scheduling. Smart grid has the following characteristics: automation, information technology, self-diagnose and repair functions. The practice of energy policies requires thorough policies and regulations. Meanwhile, the United States and the European Union have established and developed framework and rules of law in the legal system regarding smart grid. However, the framework and development of smart grid law in Taiwan is relatively slow and is ignored. Taiwan Government's overall smart grid legal system is still a lack of investment incentives and regulations of protecting and standardizing privacy and information security. Therefore, in order to promote the construction and development of smart grid regulations in Taiwan, this thesis is in an attempt to examine the smart grid development policies and important bills in the United States and the European Union and provide the overall regulatory framework in Europe and America.
