進入知識經濟的時代，無形資產的重要性日漸顯著，而在這些無形資產中又以專利權這項資產最易有價化，可以看出企業無形資產發展的趨勢。目前國內企業受限於資源上的不足、時間上的緊迫，還未將專利管理的模式建立起來。本研究企圖將國內各企業對於其在專利管理領域中的作法整合起來，以供國內企業參考。因此本研究的目的有以下兩點：
1、 由文獻的探討中，尋找企業在進行專利管理時的管理流程架構，並藉由實際個案驗證之。
2、 根據文獻及個案研究結果，對企業所面臨的專利管理提出檢核表。
本研究的研究發現有以下幾點：
1. 專利管理流程可以分為四個階段，分別是專利產生階段、專利申請階段、專利維護階段、專利運用階段。
2. 企業所正在進行的專利管理的主要活動並不完整，其作法是根據最急迫的需要來進行專利管理活動的選擇。
3. 專利產生階段必須規劃出合適的專利策略，並且有效的刺激專利產生，此外專利資訊系統的建立也是相當重要的。
4. 專利申請階段中專利人才的養成是一項關鍵性的項目，對於專利事務所的專業性確認也是現行管理模式中相當重要的一環。
5. 專利維護階段對於權利歸屬問題要確保雙方都達成共識，在教育訓練上的觀念更新上要與大環境保持同一脈動。
6. 專利運用階段必須注意的是在訂定授權契約時要謹慎制訂，以有豐富經驗的人員來進行契約簽訂的工作較為恰當。

Abstract
In the times of knowledge economy, the importance of invisible assets becomes more and more conspicuous. Among these invisible assets, intellectual property right is the easiest to be valued; can be estimated the trend of development in invisible assets as well. Nowadays, the mode of patent management still hasn’t been established because of the limitation in resources and time in domestic businesses. As a result, we try to integrate the way domestic businesses dealing with in patent management field as a reference.
There are two purposes in this research:
1. According to citation, we try to find a framework of management process when businesses are proceeding patent management and proven this by using real cases.
2. Listing a check list about business facing patent management base on the result of case research and citation.
Finally, we have the following achievements:
1. The process of patent management can be divided into four phases: producing, applying, maintaining and using.
2. The main activities in patent management now business are doing are not integrate, what their choices base on their urgent needs.
3. Appropriate patent strategy should be planned in patent producing phrase, and stimulating patent produce effectively. Besides, to establish patent information system is important, too.
4. In applying phrase, to cultivate a patent engineer is a key item. The specialty in patent affair office has influence in current management model.
5. In maintaining phrase, the issue about right belonging should have a common consensus. The idea of education training should keep the tune with the environment.
6. Finally, in using phrase, the contract of authorization should be made carefully. Experienced person is suitable for this job.
