兩岸加入世界貿易組織之政策與法制探討—以承認大陸高等學歷為例—

摘要


中文摘要 台灣已經於2002年加入世界貿易組織(World Trade Organization,以下簡稱WTO)成為繼中國大陸之後第144個會員國。會員國對於國際義務便被賦予遵守義務,他方面同時也可享有國際組織架構下應有的權利。當兩岸間既已同為WTO之會員國,理當可用WTO相關規範加以處理。來主張自身權利並維護台灣的權益。 從台灣加入GATT與WTO 等各項國際組織的歷程,來探討台灣與大陸的兩岸關係。與大陸學歷承認間有無關係。在WTO的服務貿易總協定中探討台灣教育服務業所承諾事項,對台灣高等教育「大陸學歷採認政策」未來政策走向之影響。評論 「大陸學歷採認政策」實施的法規範分析,是否確實可行,與修正之必要性與否。擬定符合國家利益之「大陸學歷採認政策」與「兩岸關係政策」,在WTO規範下符合本國政治利益又不失WTO會員身分與各項規範。 研究結果發現:政府機關已有意願修改大陸政策,並開放大陸學生來台就學,修改大陸學歷承認政策。大陸學歷承認政策與WTO與GATS制度有相當關係,應受其相關規範與遵守義務,其政策之訂定亦須遵守相關規範。目前為止有14,907名學生至大陸就學,其相關權益政府不可忽視。未來在立法政策上需符合其權益。 未來大陸學歷承認不應再侷限於海峽兩岸之關係,必須遵守國際規範與高等教育之發展,因此提出建議與省思,我國遵守WTO規範,重新思考大陸學歷開放之政策,並加大其開放範圍,政府應成立跨部會工作小組,彼此間充分協調與合作,讓此一政策回歸市場機制與教育層面,尊重各方意見,以期制定完備之政策與法令。

Abstract Taiwan had entered WTO(World Trade Organization)in 2002 , is the 144th member of WTO behind Mainland China. Since both sides of cross strait had became the member of WTO .Members are under the obligation to obey regulation and claim the rights of WTO . The purpose of this study are: 1)The research for Cross-strait in Policies and Legals After entering the World Trade Organization–the Admission of record of College formal schooling for Mainland China as Examples. The policy of department of education in recognition of higher education about Mainland China .Are there leave any of room to be improved; 2)According to the procedure of entering GATT(General Agreement on Tariffs and Trade)and WTO , analyze and compare between Taiwan and Mainland China . Are there some relationship to do with the recognition of higher education about Mainland China ; 3)In the framework of WTO/GATS(General Agreement on Trade in Services), to confer the promises of Taiwan educational services and its influence on “the policies of the admission of record of College formal schooling for Mainland China” ; 4) Comment on “the policies of the admission of record of College formal schooling for Mainland China” and are they practicable or correct necessary ; 5) To set up the policies to fit in with Taiwan’s benefits and do not violate the regulation of WTO . The result of this research are :1)The government are willing to change the policies on the admission about record of College formal schooling for Mainland China . To make Mainland China high school students open to public access and study Taiwan’s university ; 2) Since the policies of recognition of Mainland China are associate with numerous regulations of WTO and GATS ; 3)More than 14,907 Taiwan students have been studying in the universities of Mainland China ;(4)Issues of the admission about record of College formal schooling for Mainland China should be discussed under the framework of WTO and policies-making should be obey too. The policies-making about the recognition of Mainland China higher education should not be restricted within the relationship of both sides of cross straits. The suggestions of this research are : obeying the WTO regulations , we should reconsider the policies to recognize the higher education of Mainland China . Cross bureau working team should be set up to take charge of the affairs about the recognition Mainland China higher education .The team should cooperate each other . Let these affairs back to the market mechanism and education itself.
