促進我國物流產業之法律對策

中文摘要隨著全球化及區域經濟快速成長，跨國企業的成功關鍵在於全球性資源的取得與整合運用，因而發展出全球化運籌管理策略以降低成本並滿足消費者需求。亞太經濟區域的地理位置大多數於海島型地理，故必須仰賴水運及空運進行不同國家間之資源流通，由此可知在亞太經濟區域中「物流」相關產業之重要性。然而，物流產業涉及跨國流通，須有通關、運送、倉儲、流通加工、資訊及其他物流週邊服務等作業配合，因此一部健全之法律制度將有助於物流業者拓展國際市場，進而提升其競爭力。在亞洲共同市場即將成型的關鍵時刻，台灣如何發展物流相關產業，再輔以自身的各項優勢條件與經濟正在起飛之中國大陸相互競爭與合作，開通進入亞洲共同市場的門戶進而與世界接軌，建立名符其實的「全球運籌中心」，是本文研究之目的。本研究希望藉由探討全球化及區域競爭的壓力下，台灣積極推動全球運籌計畫的重要性，並透過瞭解日本物流發展的成功範例，對應台灣物流產業發展的缺失，進而提出若干建言(含政策面建議及執行面建議)供政府作為發展全球運籌中心之參考。

Abstract With the globalization and regional economic growing rapidly, the key to success of the multinational enterprises lies in the acquisition and integration of global resources used, and thus develops global logistics management strategies to reduce costs and meet consumer demand. Because most of the Asia-Pacific economic geography is island, it must rely on water and air transportation to the resource flows between different countries. Therefore, industries relating "logistics" are very important in the Asia-Pacific economic region. However, due to the logistics industries involving cross-border flows, there must be customs clearance, transportation, storage, distribution processing, information and other logistics services to cooperate each other, so a sound legal system will help the logistics industries to expand the international market, thus increasing their competitive force. At the critical moment of a common market shaping in Asia, how to develop the logistics-related industries in Taiwan, and then supplemented by the advantages of our own conditions and compositing and cooperating with China where economy is taking off. In the meantime, there is an opening gateway into the Asian common market and thus with the world. According to the aforementioned, the main purpose of this article is the establishment of a truly "global logistics center". This article describes the importance to actively promote the importance of global logistics programs in Taiwan by studying the stress of globalization and regional competition, and reflects the defect of the development of logistics industry in Taiwan through an understanding of Japanese logistics development success story, and then gives a number of suggestions (including the policy and implementation) for the government as a reference to developing a global logistics center in Taiwan.
