建構具可專利性與可用性之新產品開發創新價值模式

摘要


可專利性(patentability)取決於法律規範三要件:新穎性((novelty)、進步性(Unobviousness)與產業利用性(Usefulness),是作為核准專利之基準。近年來專利訴訟案,可專利性價值爭論,衍生出專利訴訟濫用(misuse)之情事,造成經濟損害,產業技術將停滯不前,致使專利數量與價值性降低問題。 為提升可專利性之價值,申請人對於已公開專利技術,得從事更深入進步之技術研發,進而體現可專利性立法目的。企業在產品設計開發擁有技術研發,但缺乏專利迴避與人因考量,往往造成產品結果無法將兩階段緊密連結,使其產品侵權與使用者意願降低,亦使得可專利性價值無法體現至產業競爭力,以上是目前以專業代工為主的台灣所面臨窘況。 專利分析可降低侵權風險,TRIZ理論則可提供設計來源滿足人因可用性之使用者需求。過去研究未見有效整合,本研究使可專利性價值提升,建構一套整合專利分析、人因可用性及TRIZ理論的新模式-「可專利性與人因可用性創新價值模式(Patentability and Usability of Innovative Value, PUIV)」,本研究可體現可專利性價值至產業競爭力,作為引導企業產品開發之準則,使研發設計者有系統萃取專利情報(Intelligence)檢準率,提升專利技術進步性,達成產品可用性之效能,以互補智慧創新概念與手法整合妥適運用得以產生經濟效益,展現可專利性價值之所在。 本研究PUIV模式透過樂齡族進食輔具實例驗證,可達成(1)九宮格關鍵字萃取專利情報達90%檢準率;(2)提供適切產品七項人因可用性客觀指標;(3)演進線結合七大可用性指標提升專利進步性;(4)融入可用性指標,滿足樂齡族自我需求與使用高度效能之重要關鍵因素;(5)可專利性與人因可用性價值評估;(6)建立企業智慧財產的舉證證據 藉由專家與使用者的共同參與,實證建構出可專利性與人因可用性模式之可行性,以專利整合施用人為本的創新研發,為智權成果商業化帶來可專利性價值新契機,展望未來產品兼具高附加價值之可專利性與人因價值利基。

In patent law, patentability is determined by three crucial elements as patent approval criteria: novel, nonobvious, and useful. In recent years, patent litigation has involved debates on the value of patentability, which drives the misuse of patent litigation, damaging the economy. Consequently, industrial technologies stagnate, weakening the quantity and value of patents. To enhance the value of patentability, applicants must dedicate progressing technological research and development toward open patent technologies to realise the legislative purpose of patentability. Enterprises are capable of conducting technological research and developing products but lack patent circumvention and human factor consideration policies, which typically produces products that are unable to closely link the two development stages. Consequently, patent infringement cases occur and user intentions decline. In addition, the value of patentability fails to become industrial competitiveness. These are the current industrial predicaments in Taiwan, particularly in original equipment manufacturing. Patent analysis reduces infringement risks. The theory of inventive problem solving provides resources for design ideas and satisfies user demands related to human factors and usability. These have never been effectively integrated in previous studies. In this study, the value of patentability was enhanced and a new model integrated with patent analysis, human factors and usability, and the theory of inventive problem solving was constructed: patentability and usability of innovative value (PUIV). The value of patentability was incorporated in industrial competitiveness as a criterion for guiding product development. This enabled research and development designers to systematically extract precision ratios on patent intelligence data and accelerate advances in patent technology. Thus, performance targets related to product usability can be met. Complementary, intelligent, and innovative concepts and methods can be integrated and applied to generate economic benefits and demonstrate the value of patentability. In this study, the PUIV model was empirically verified using senior feeding aids. The following results were obtained: 1) A 90% precision ratio in three-by-three patent intelligence data extraction; 2) seven human factor and usability criteria for providing suitable products; 3) seven major usability factors integrated with lines of evolution for accelerating patent advancements; 4) usability measurement technologies for verifying the high usability performance of new feeding aid products.; 5) value assessment on patentability, human factors, and usability; and 6) proof of evidence on enterprise intellectual property. Through expert and user participation, the feasibility of the PUIV model was verified. Innovative research and development using people-oriented patent integration and application generates new possibilities in patentability values for commercialising intellectual rights outcomes and developing products that simultaneously exhibit high added values in patentability and the human factor niche.
