摘要

博弈產業在世界各國肩負著帶動相關運動產業、發展地方經濟及國家稅收等重要角色，該產業發展項目包含：大型觀光賭場、賽馬、彩券及各種運動彩券。其中以美國內華達州拉斯維加斯最具其代表性，亞洲則是以日本、新加坡及香港經驗最為成熟，台灣目前僅屬起步階段。
我國於2009年7月1日公佈施行「運動彩券發行條例」，欲藉由該條例之施行，將所生盈餘挹注於國內體育發展，培育體育人才。因此，我國運動彩券發行具有開展博弈產業及提升體育發展之雙重責任，如何使運動彩券從發行銷售至管理層面有所依循、盈餘得有效供體育發展之用、建立經銷輔導與管理制度，同時顧及社會風氣及觀感，達成盈餘運用效益最大化之目的、維護運動彩券之公正、公平及公開，為本文所欲探討目標。
本文主要蒐集博弈產業相關法律資料進行歸納分析，探討博奕產業與國家體育發展之影響，以及相關法規內容在適用上所生之疑義。主要以博奕產業法規範作為背景框架，「運動彩券發行條例」作為探討核心，依序探討國外運動彩券發行、我國彩券發展沿革、運動彩券發行機構與經銷商、賽事公平性、盈餘使用與管理及虛擬投注等相關議題。參考國外文獻及相關法律制度，以文獻整理方式提供我國運動彩券制度或未來離島觀光博奕產業之參考。

Lottery industry plays a significant role in promoting sports industry, economy, and national taxation. It includes：Casino, Horse, Lottery, and Sports Lottery. Las Vegas is the most representative city developing it in the world. In the meanwhile, Japan, Singapore and Hong Kong develop it maturely in the Asia. On the contrary, Taiwan is still at its preliminary stage.
Taiwan has published the Sports Lottery Act and made it in force on July 1st 2009. It allocates the profit of sports lottery into sport developing and athelet training. Therefore, Taiwan issued the sports lottery with abilities to promote lottery industry and national sports. The purposes of this thesis are stipulating the regulation when government issues the lottery, allocating profit into sport developing effectively, setting up the statute of sales and managment, concerning the social opinion at the same time, achieving maximum benefit from the lottery profit, and making sure its justice, fairness and openness.
This thesis collects relevant literature and analyzes the law framework of lottery industry. It discusses the influence of developing the lottery industry with national sports, and the debates on the application of related laws. The discussion which the thesis focuses on is the regulation of lottery industry, it discusses a few important issues below：the experiment of issuing the lottery overseas the history of issuing lottery in Taiwan, the institution and dealers of selling lottery, the fairness of the sport competitions, and profit managing and sports betting. This thesis reviews foreign reference and relevant legal systems. It provides the suggestion about our legal system of lottery industry or offshore islands development.
