兩岸交通事故特別補償基金之比較研究

The Comparative Study on Special Compensation Fund across the Taiwan Strait

摘要

《強制汽車責任保險法》在台灣已經實施十餘個年頭，而對岸也在2006年6月頒布《機動車交通事故責任強制保險條例》，為了健全該制度，各國設有補償基金或類此制度以確實保障無法依該責任保險獲得補償之受害人。

本文就台灣及大陸所設置之特別補償基金或特別救助基金作比較，首就基金之設置目的、性質出發，再參酌各國先進立法例，檢視兩岸有關特別補償基金之法律條文，並試圖就補充性理論之角度，提出本文拙見及建議，希冀能對兩岸之特別補償基金及特別救助基金有所裨益。

The Compulsory Automobile Liability Insurance Act has been implemented for more than one decade in Taiwan, on the other hand, the Motor Vehicle Accident Compulsory Liability Insurance Regulation was decreed in June,2006 in Mainland. For strengthening and completing the liability insurance system, many Countries establish the Motor Vehicle Accident Compensation Fund to ensure to protect those victims who may not acquire the compensation from the liability insurance.

This study compares the Motor Vehicle Accident Compensation Fund across the Taiwan Strait basing on the purpose of establishing, the nature of the fund, and reference other countries related acts. And the study also in the view of the principle of subsidiarity, attempts to evaluated the legal issues and suggestions. Hopefully the findings could be usefully for the Motor Vehicle Accident Compensation Fund across the Taiwan Strait.
