Cooper曾指出公共行政中最典型的倫理困境就是責任衝突,Harmon也認為一旦行政人員所承擔之不同責任發生互相扞格之情境時,行政人員內心的痛苦與折磨就如同「受煎熬的靈魂」一般。而政務官相較於一般行政人員,除了對於國家重大政策之走向具有相當大的影響力之外,由於受政治任命之故,更使其承擔了特有的政治責任,其所面臨的責任衝突困境也可能更為複雜。 近來我國政務官面臨責任衝突困境之個案亦時有所聞,本研究因此欲以前法務部長王清峰辭職為個案,並以政治責任、職務責任與個人責任為理論架構,輔以文獻探討法與深度訪談法進行政務官責任衝突之研究,期望能探究出政務官所面臨的責任衝突困境,找出進行責任優先排序之因素,進而提供我國政務官紓解責任衝突困境的相關建議。 研究發現個人責任在政務官任職前後具有不同的重要性,而依法行政始終為尋求正當性的最重要基準,因此政務官不僅應以個人理念衡量是否適宜接任政務官一職,在任職後若發現其個人理念無法獲得支持時,政務官選擇辭職負責為展現政治責任風骨的較佳選擇。
Cooper has pointed out that the most typical dilemmas in public administration is the responsibility of conflict. Harmon also believes executives assumed responsibility for conflict, executives inner pain and suffering just as "tortured soul". Political official compared to the executives, in addition to major national policy trend has a considerable influence, therefore due to political appointments, but it assumed the unique political responsibility, they face the responsibility of conflict may be more complex. Therefore, in this study, a case from the resignation of Justice minister Wang Ching-feng, uses political political responsibility, official rduties and personal responsibility as the theoretical framework, and uses literature review with in-depth interviews to study responsibility conflict of Political Offical. Expect to understand the conflict of the responsibility of Political Official, find out the responsibility of the priority ranking factors, and then provide the relevant recommendations of the Political Official to relieve the responsibility for conflict.
