現代國家隨著時代之變遷,其所承擔之任務不論於質或量上皆呈現出高度成長已屬不爭之事實,面對著與日俱增、日形嚴峻之種種考驗,國家似乎已漸漸顯露出「獨木難支」之疲態,因而有必要對此等問題重新進行檢視以尋求對治之道。為了解答此項難題,所謂之公私協力,亦即由國家與社會部門共同處理公共事務之情形,不論於實踐上與理論上,無疑已經成為重要研究課題之一。然公私協力之態樣,其實並不限於公共服務之給付、公共建設之參與等領域,自我管制(公私協力管制)亦屬公私協力項下之一環,因而可為國家管制失靈之現象帶來若干啟發與助益,而本文即以此種行政法上自我管制作為研究之主題,並將本文架構介紹如下。 首先於第二章,必須先就自我管制之上位基礎理念進行論述,亦即對公私協力以及合作管制進行說明。由於自我管制涉及到公私部門共同協力合作以達成特定管制目的之議題,因而有必要先就是否具有國家保留任務、國家在公私協力中所應扮演之角色,以及國家在此等情況下應當改變管制思維,朝著合作管制之方向前進之流程進行探討;其次,在第三章則對於自我管制之概念、動機、基本理念、於各行政領域之實踐,以及法理基礎等進行說明,以對其有一個大致之認識與理解;嗣後於第四章,則對業界團體之自我管制關係進行分析,由於此等關係涉及到複數主體、多面向法律關係以及多元利益調和之問題,因而必須對其類型、優缺點、基本權之保障、民主正當性之要求等進行介紹,並從行政法律關係理論之角度進行觀察,希望借由此等理論之概念導引,俾有利解決業界團體自我管制關係所具有之問題;至於第五章,由於業界團體之自我管制與功能自治於外觀具有相似性,故將功能自治與公法上社團法人進行介紹,一併探討我國業界團體之屬性與地位,希冀借由兩者之概念比較,以強化對於自我管制之認識與理解;最後,則對於上述議題之探討作出總結,希望對自我管制有進一步之認識。
As time goes by﹐it is already an undeniable fact that Modern state assumes the task of both the quality and quantity revealed a high degree of growth﹐and that in the face of growing all kinds of tests on the stringency seems to reveal weakness by degrees. It is necessary to re-examine these issues to find a way on governance. In order to solve this problems﹐there is no doubt that the Public-Private Partnership, which jointly by the state and social sectors to deal with public affairs has become an important research topic. Since the Self-regulation is also one of Public-Private Partnership concept and could bring some inspiration and support to the phenomenon for the failure of state regulation, this thesis is that such Self-regulation in Administrative Law as a research topic and the structure is as follows. In chapterⅡ﹐as the Self-regulation related to public and private sector to work together to achieve a specific objective of the regulation issues﹐it is necessary for the state to transform the regulation of thought and change the direction toward cooperative regulation. In chapterⅢ﹐to describe the concept of Self-regulation, motivation, basic idea, in various administrative areas of practice, and explain the legal basis, etc. In chapterⅣ﹐to analyze the relationship of Self-regulation of guild. As these relationships involve complex subject, and more for the legal relationship and the issue of reconciling diverse interests, which must be its sort, advantages and disadvantages, and basic rights protection, democratic legitimacy of the requirements are introduced, and from the perspective of administrative law relationships were observed, would like to take this concept to be theoretical guidance, conducive to resolve these issues above. In chapterⅴ﹐as Self-regulation of guild and Functional Autonomy are similar in appearance, it is necessary to introduce the latter and compared with the former, in order to strengthen the knowledge and understanding of Self-regulation of guild. Finally, the issues above will be discussed for conclusion.
