政府捐助財團法人的存在是政府因應特殊行政任務需要,或為達成特定政策目的,所捐助成立或依法設置,其成立可以使政府不增加原有的員額編制下將資源和人力妥善運用,發揮公益,並且較政府運作更為靈活和彈性。但近年來,相關政府捐助之財團法人的管理受到社會輿論的質疑,政府於是透過法制化積極監督法人的作為,但如何在政府增強監督密度的情況,保持政府捐助之財團法人自主的彈性,是雙方在互動之下可能遇到的兩難,更是政府在互動之中應該思考的問題。 本論文將採取文獻探討法、深度訪談法及問卷調查法,進行公共課責的研究,試圖暸解內政部的各該目的事業主管機關與其政府捐助之財團法人的互動狀況,所可能產生且引發的相關運作、監督、和管理層面的問題,探討何以會產生這樣情形的原因,期望能藉此找出問題的癥結點,並提出一些建議。
The function of government funded nonprofit organizations is to perform special administrative projects, or for specific policy goals. The establishment of government funded NPOs could fulfill public interests with more flexibility without increasing public sectors’ budget to cover labor force expenditure. In recent years, the supervision and management of government funded NPOs are being questioned by the public, hence, to meet public opinions expectation, the supervision and management of government funded NPOS becomes more constrained by legislation. However, it is public sectors duty to keep in mind that while practicing supervision, to preserve government funded NPOs autonomy and flexibility features at the same time. This study uses literature review, in-depth interviews and questionnaire survey methods to study on public accountability by exploring the interaction between Ministry of the Interior and the government funded NPOs. Moreover, to discuss problems related to operation, supervision and management of government funded NPOs that may arise among the interaction between the public sectors and the NPOs. Finally, the author would explore on reasons of the problems mentioned above, and to bring up some policy suggestions.
