我國消費者保護法自民國八十三年立法以來,雖經歷民國九十二年、九十四年兩次修法,然而關於郵購買賣、訪問買賣之適用依然爭議不斷,諸多爭議中,部分或可適用現行法律予以解決,部分則須透過法律解釋或法學方法處理,更有部份則因現行法律未設有明文規定而有待修法或立法必要,本文撰寫之目的在於釐清前揭諸多爭議及其處理方法,並就問題提出適當解釋及建議。 本文研究主題為台灣與日本關於特種買賣規範之比較,主要係以我國消保法與日本特定商事交易法兩部法律作為比較對象。由於我國消費者保護法與日本特定商事交易法關於特種買賣種類之交集在於訪問買賣、郵購買賣、電話推銷買賣此三種類型,因此本文之研究範圍亦限定在兩部法律之共同交易類型(即訪問買賣、郵購買賣、電話推銷買賣)作為研究對象。 本文之研究目的在於,就現行消費者法制中與特種買賣相關問題及法律條文適用疑義,提出可能之處理方式及建議,研究方法主要係考察日本特商法之規範內容,對照我國消保法相關規定及實務見解,比較兩部法律異同之處,藉以觀察有我國法制有無不足之處以及如何改進之方法。具體言之,本文首先於第二章介紹日本特定商事交易法,其內容包含其立法背景與沿革、立法目的,並就本研究主題相關之訪問販賣、通信販賣、電話推銷販賣之制度內容與具體條文予以說明。其次於第三章就我國訪問買賣與郵購買賣之制度提出說明,並就實務常見相關問題說明適用法條、整理主管機關之實務函釋以及學者見解,其用意在於與第二章內容相互對照,觀察日本特定商事交易法與我國現行法制之異同。第四章具體比較特商法與我國消保法之內容,探討我國消費者保護法與特定商事交易法對於相同問題之處理方法,並於文末提出本文建議。最後於第五章提出本文結論。
The main research subject of this dissertation deals with Act on Specified Commercial Transactions such as door-to-door sales, mail order sales, telemarketing sales etc. in Japan. A comparison of consumer protection law of Japan in this field of research to National law of Taiwan has also been made. The field of research has been restricted to commonality of the laws of both country, the purpose is to highlight the problems of the effective consumer protection law concerning extraordinary purchase and sale and the appliance of this law at this field. Problems and questions that arise are identified, analyzed and possible solutions and proposal are made. The method of research is mainly the study of Act on specified commercial transactions of Japan and compare with explanations of consumer protection commission. The main goal is to identify the deficiency of the national law and to find methods for its improvements.
