軍人洩密犯罪特性及其防制策略之研究

摘要

近來隨著兩岸政策的調整，文化、經貿等交流越趨頻繁，兩岸在形式上看似係良性的發展，但中國大陸仍未真正放棄武力犯台，反而更以多元之方式民間交流，但是不可否認的是，在這和平的情況下，中共仍持續對我進行滲透，本研究蒐集2002年至2015年有關軍人洩密犯罪(共諜案)罪判決書及相關媒體報導23件，研究結果發現：軍人洩密犯罪發生的犯罪模式，可分成「因親情之託肇生洩密犯罪」、「因遭軍中舊識吸收肇生洩密犯罪」、「中國大陸反間而肇生洩密犯罪」、「因個人行為不當遭吸收洩密犯罪」、及中國大陸吸收洩密犯罪」等。
本研究研究方法主要為「內容分析法」，經分析結果發現涉案軍人具有的特徵為：（1）個人軍人武德式微。（2）具低自我控制特性。（3）理性選擇錯誤。（4）受情感羈絆影響。(5) 遭恐嚇威脅就範等。
最後建議以情境犯罪預防方式來增加洩密犯罪阻力、增加洩密犯罪風險、減少洩密犯罪誘因、減少洩密犯罪刺激、移除洩密犯罪藉口、強化人員考核及運用測謊等策略來防制軍人洩密犯罪發生。

In recent years, as a result of adjustment of China-related policy, there are more and more interactions in cultural, economic and trade exchanges across the strait, It seems positive interactions across the strait, but China never give up to fight Taiwan in force ,On the contrary, China show more and more pluralistic way to people-to-people communication . It is not deniable that infiltration, subversion, and sabotage are happening under the peaceful cover. This study is based on concluding related judgment about divulging secrets offense from 2002 to 2015.
The method of research is mainly based on Content Analysis, we found that the characteristics of military divulging secrets, as follows: (1) the individual Military morality decline;(2) low self-control characteristics; (3) the error in rational choosing;(4) impact by emotion fetters and (5) be threaten.
Finally ,in order to reduce this illegal, this study sugget that Military can use the way of Situation crime Prevention as follows:
1.Increasing the resistance of the divulging secrets;
2.Increasing the risk of divulging secrets;
3.Reducing incentives for divulging secrets;
4.Reducing crime stimulus in divulging secrets;
5.Removing excuse crime in divulging secrets;
6.Strengthen personnel evaluation;
7.Using the way of polygraph
