大陸人士取得台灣不動產物權之審核與管理課題分析

An Analysis of Examining and Administration Issues for Mainland Chinese to Acquire Property Rights in Taiwan

摘要


近年來兩岸政治關係逐漸趨緩,在經濟交流上也越來越頻繁,但針對是否進一步開放大陸人士取得台灣不動產物權的意見始終不一,也間接導致台灣對於大陸人士與外國人士的相關規定產生差異,此現象引發本研究關切,本研究透過文獻回顧、國外相關規範與受訪者意見,擬定政府對大陸人士取得台灣不動產未來可調整的方向。其問卷分析的方式,以受訪者的職業、居住地、教育程度、年齡層、個人平均年收入、居住房子類型、曾到大陸次數、性別八項基本資料,針對各題項交叉分析,瞭解變數之間相互的關聯程度,期許透過分析結果、政府審核與管理課題現況以及研究者本身意見,探討是否存在政策落差。本研究問卷分析結果指出,70%以上的受訪者對於大陸人士取得台灣不動產以及相關議題,均認同政府應嚴格對待。46%的受訪者雖然較不同意大陸人士來台取得自用性不動產,但在大陸人士專業技術移民與投資移民卻有將近50%的同意程度,此部分的意見可成為政府未來促進兩岸交流或是放寬審核標準的突破點,55.5%的受訪者亦對未來台灣的審核與管理課題認為應嚴格審核與嚴格管理,本研究並發現年輕人、學生族群、居住北部人士對於大陸人士取得不動產相關的議題較為樂觀,未來政府在相關政策的考量上必須考慮上述之差別。本研究建議未來可採總量與面積管制的概念,且對於大陸人士取得不動產違反規定時,建議政府能以適當的懲處方式,以達到有效嚇阻的目的。此外,如果未來大陸人士申請取得台灣不動產的案件數大量增加,中央審核單位亦可考慮下放部分審核權力予以地方政府以增進效率,故本研究建議政府在改變的過程中,以漸進式開放為短期政策方向,最終達到「積極開放,嚴格管理」的目標。

Over the last few years, the cross-strait political relations have gradually eased up, and the economic exchange between the two countries has become more and more frequent. Noise about mainland Chinese obtaining Taiwanese real estate varies, and the real estate situation in Taiwan has indirectly caused there to be differences in the real estate rules and regulations for mainland Chinese and those for foreigners of other countries. The above phenomena have lead to this study. In this study, survey analysis is adopted to literature review, related rules and regulations in other countries, and opinions of interviewees are given to provide assistance to Taiwanese government officials in the adjustment of regulations and rules in the future for mainland Chinese that seek to or will obtain Taiwanese real estate. And survey cross-analyze include eight basic data of interviewee occupation, living location, education level, age group, yearly income, type of housing, number of times they have been to mainland China, and gender in order to understand the relationship and degree of correlation between variables. It is hoped that through the analyzed results, government audits, current situations of management issues, and the opinions of the researcher to investigate whether or not there are differences in political policies. Results garnered from survey analysis include the following: More than 70% of interviewees agreed that the Taiwanese government needs to use strict treatment in connection to issues related with mainland Chinese obtaining Taiwanese real estate. Although 46% of interviewees do not prefer or support mainland Chinese coming to Taiwan and obtaining real estate that they will live in, however nearly 50% of interviewees agree with mainland Chinese that have specialized or technical abilities being able to immigrate to Taiwan, and they also agree with Taiwan investing in immigration. The above opinions can become a breakthrough point for the Taiwanese government in promoting exchange between Taiwan and China in the future or relaxing auditing standards. 55.5% of interviewees believe that in the future both auditing standards and management need to be stricter. This study discovered younger people, students, and citizens from northern Taiwan have a more optimistic outlook towards issues related to mainland Chinese obtaining Taiwanese real estate. Moreover, government officials must think about the differences stated above when they are considering government policy related to real estate in the future. This study suggestions about a concept of control created for the total amount and area of property that can be acquired in the future . There are also suggestions for the government on making appropriate penalization methods for mainland Chinese that do not obey rules and regulations when obtaining real estate; the penalizations are supposed to help meet goals of effectively deterring unlawful real estate obtainment. Also, if the amount of cases of mainland Chinese applying for obtaining Taiwanese real estate increases, the central auditing organizations can consider delegating some auditing authority to local governments to increase efficiency. This study suggests that the Taiwanese government, during the state of changing, should gradually open up the real estate market to mainland Chinese by adopting short term policies, and in the end reach a goal of being completely open while having strict management.
