地方公立棒球場以OT模式經營之研究- 以「桃園青埔國際棒球場」及「台南市立棒球場」為例

摘要


台灣地方公立棒球場目前多由地方政府編列預算經營,而近年來,因應「促進民間參與公共建設」之政策,有少數地方政府與企業球團合作,雙方簽訂合約,以OT(Operate-Transfer, 以下簡稱OT)的模式委外經營,政府轉為監督者的角色,企業球團則提供資金及專業技術,負責球場的經營與管理。本研究的研究目的在於了解地方棒球場與地方政府及民間企業(認養球團)之間的關係、以OT模式委外經營地方棒球場的可行性、地方政府與民間企業(認養球團)之間的目標與考量、不同環境之下適用模式之問題。   本文首先從委外的意涵與執行模式說明,再聚焦於OT模式之探討,並整理出國內相關文獻之研究,以及運用「公私夥伴關係」(public–private partnership)及「雇主-代理人理論」(principal-agent theory)作為本文之研究基礎。進而以「桃園青埔國際棒球場」及「台南市立棒球場」為例,進行深度訪談以了解個案目前的執行現況。內容主要是分析兩個地方政府及企業球團採行OT模式的考量,最後再整合出地方棒球場構成OT的內容,加以探討。   從本研究可以發現:第一,委託民間經營地方棒球場各有其優缺點,優點為減輕地方政府財政負擔、引進專業人才及技術以管理球場、專業管理及效率品質的提升、營運財務由得標廠商自負盈虧等;缺點則有法令適用問題、雙方溝通介面、公務程序繁複、各種風險等。第二,委外民間經營地方棒球場所須具備的條件有三方面,分別為落實可行性評估及先期規畫、契約中須明訂雙方的權利與義務、及訂定營運績效評估辦法。第三,地方政府與企業球團對於採用OT模式委外的考量重點有其相異之處,包含尋找委外對象的考量重點、誘因、契約目標等,從不同的立場可觀察出兩方中值得注意的重點。第四,現行運作上存在某些問題,例如法源不一、績效評估辦法及內容未定、公益性不足及缺乏配套措施等問題。   本論文就上述研究發現提出相關建議:針對法律、績效評估、公益、配套措施等方面的不足之處,提出具體作法,以及分別對於地方政府及企業球團提出策略建議,以作為未來相關案例執行之參考。

Taiwan's local public baseball field currently more from local government budget management, but in recent years, in response to "Promotion of Private Participation in Infrastructure Projects" policy, there are a few local governments and enterprises pellets cooperation, the two sides signed a contract to OT (Operate-Transfer, hereinafter referred to as OT) model outsourcing business, government watchdogs into the role of corporate pellets provides funding and technical expertise, responsible for the operation and management of the stadium. Purpose of this study is to understand the local baseball field with local governments and private enterprises (Adopt pellets) the relationship between the outsourcing business model in OT feasibility of local baseball field, local government and private enterprise (Adopt pellets) of between the objectives and considerations applicable to the model under different environmental problems.   Firstly, from the meaning and implementation of outsourcing model description, and then focus on the OT model discussed and sorted out the domestic literature research, and the use of "public-private partnership" (public-private partnership) and "employers - agency theory "(principal-agent theory) as the basis of this study. Turn to "Taoyuan International Baseball Stadium Cingpu" and "Tainan Municipal Baseball Stadium", for example, in-depth interviews to understand the current status of implementation of the case. Content is to analyze two local governments and enterprises to adopt OT mode pellets considerations, and finally integrate the local baseball field constitute OT content to be explored.   From this study can be found: first, commissioned by private operators have their advantages and disadvantages local baseball field, the advantage to reduce the financial burden on local governments, the introduction of professional and technical personnel to manage the stadium, professional management and efficiency of quality improvement, operational finance from the get tenderer self-financing, etc.; disadvantage with applicable laws and regulations, the two sides of communication interfaces, official complicated procedures, a variety of risks. Second, outsourcing privately run places where baseball conditions to be met in three aspects, namely the implementation of the pre-feasibility assessment and planning, contract must express the parties' rights and obligations, and setting the operational performance assessment approach. Third, local governments and enterprises pellets for the use of outsourcing key considerations OT mode has its difference, look for outsourcing object that contains key considerations, incentives, contract goals, etc., can be observed from different positions of the two prescription noteworthy point. Fourth, there are some problems on the existing operation, for example, different sources of law, performance evaluation methods and content yet, shortage and lack of public support measures and other issues. In this thesis, the above findings suggestions: For legal, performance evaluation, welfare, supporting measures and other aspects of shortcomings, propose specific practices, as well as local governments and enterprises, respectively, for pellets made policy recommendations for the future implementation of relevant cases reference.
