勞工於無薪休假中權益之保障

摘要


本文主要探討內容為如何在景氣不佳期間提供勞工適當的保障。於2008年下半年度後,由於國內企業受到國際景氣不佳的影響而紛紛實施無薪休假措施。於我國必須透過勞工與雇主雙方合意的方式後方能進行。但由於勞工與雇主間地位之不平等,導致以合意行為實施無薪休假有其天生的缺陷。因此為了解決這個問題,本文將提出其他的解決方式。 而就國內文獻而言,有部分學者對於無薪休假這個議題進行討論。不過關於情事 變更原則是否得以適用於無薪休假的案例中與勞工保險對於勞動契約存續中關於工資差額的保險則較少有探討。因此,本文將著重於這個部分進行分析與說明。而在外國法的部分,本文主要以德國與日本法為比較對象,探討日本與德國如何處理類似無薪 休假的停工問題,以做為我國未來制度設計的考量。 最後,關於無薪休假的問題本文認為於特定前提下將可能得以適用情事變更原則 。且本文將提出法院適用情事變更原則處理無薪休假問題時所須審酌的標準為何。此外,關於無薪休假期間工資差額的問題,本文也將透過工資補償保險機制來加以處理這個問題。而本文在內容上第一章為前言部分。第二章為無薪休假的發展現況,透過背景資料的介紹,以了解目前的概況。第三章為無薪休假與勞雇權益的平衡,主要探討目前實務如何處理無薪休假問題,且提出情事變更原則有無適用的初步分析。第四章為外國與我國法制之比較,以日本與德國之經驗為探討內容,分析我國目前制度的缺失之處。第五章為勞工權益保障的可能發展,探討內容為情事變更原則與保險機制的導入。第六章則為結論部分。

This thesis discusses how to offer labors about appropriate protection in the period of bad prosperity. After the second half of 2008, enterprices have implemented unpaid leave due to the bad business cycle. In Taiwan, this measure will be done after the agreement between labor and employer and their unequal status make a nature defect that unpaid leave based on the consent. This study has found other ways to solve this kind of problem. In the domestic documents, there are parts of scholars having discussed this big issue. The cases are few that is good to the clausula rebus sic stantibus apply to unpaiding leave or not and the labor contract about the protection of the difference from wage labor protection. Thus this thesis would analyze and explain this part deeply. About the part about the foreign laws, this thesis compared with German and Japan and investigated the two countries how to deal with the problem about unpaiding leave so that could become the style of our system in future. Finally, this thesis considered that in the specific precondition the problem about unpaiding leave maybe would apply to clausula rebus sic stantibus. This thesis also offered the standard of the discreet thinking that court applys to clausula rebus sic stantibus about dealing with the problem of unpaiding leave. Plus, this thesis dealed with the problem about wage difference in the period of unpaiding leave through wage compensating system. The first chapter is preface. The second chapter is the status about unpaiding through the information to realize the condition. The third chapter is the balance bewteen the unpaiding leave and employer and employee interests. It discussed how the practices process unpaiding leave and if it offered any adequate preliminary analyzation to the clausula rebus sic stantibus. The fourth chapter compared our legal system with foreign ones. It based on the experiments with Japan and German and to analyze our defects. The fifth chapter is the possible developing of the protection of labor rights and discussed the clausula rebus sic stanstibus and the insurance system. The final Chapter is conclusion.
