園區住民參與國家公園管理之研究-以陽明山國家公園為例

摘要


在邁向民主化國家之政治體制,公共政策無法在欠缺人民意見且忽略人民需求之下完成,國家公園治理亦同,沒有當地住民的認同與支持,難謂成功的保育政策。早期國家公園管理策略是以保護棲地與瀕危物種為前提,現今管理政策則以促進環境資源永續利用與公平分享之多元治理為目標,將當地住民和社群之參與納入政策規劃與執行體系中,儼然成為全球保護區管理的必然趨勢,住民參與不僅強化政策正當性且增加住民與政府間之良善互動,並可針對複雜的環境政策提出更為永續的執行方向。值此中央政府組織改造即將成立國家公園署之際,台灣地區國家公園管理機關應強化住民參與制度,除了參考全球保護區住民參與管理之觀念與作法之外,並應儘速進行本土化研究,以建構台灣國家公園之住民參與機制。 本論文以陽明山國家公園為例,藉由公民參與理論探討並建立園區住民參與國家公園管理之機制,採文獻分析法及深度訪談法進行研究,兼以理論與實務之印證分析,本論文之研究發現如下: 一、管理機關政策制度面: (一)國家公園依法設置,並為國家重要建設計劃 (二)國家公園管理政策直接且持續影響園區住民權益 (三)國家公園管理政策依法訂定,納入參與機制改變傳統管理政策 (四)現階段執行方式包括告知、資訊揭露、諮詢及參與等方式 (五)住民參與諮詢制度較為不足 (六)法制作業及行政程序建立有待加強。 二、園區住民及相關機關意向面: (一)住民參與以維護權益為主要目標 (二)外在環境因素影響住民具參與意願 (三)訴求環境正義為住民對國家公園管理的主要爭議 (四)園區住民對國家公園管理政策傾向負面認知,增加政府管理困難 (五)目前住民參與國家公園管理以調解爭議為主 (六)除住民外,民間團體亦是國家公園管理之重要參與者。 三、管理機關與園區住民之互動關係: (一)管理機關與園區住民間對國家公園管理認知落差主要在鄰避議題 (二)機關任務與住民訴求可能形成管理困境及政策僵局。 本論文就上述研究發現,分別提出建構園區住民與國家公園管理機關間的互動機制和建立制度性的住民參與管理之建議,以作為環境政策衝突管理之策略工具,期能達到兼顧國家公園保育宗旨及參與互惠之目標,提升園區住民與國家公園和諧互動之價值。

In the past, the administrative strategies of national parks took habitat protection and endangered species as the premise, while the current administrative strategies aim at diverse management including the sustainable use and fair availability of environmental resource. The resident participation is in the trend for the management of global protected areas now, so we should conduct the local research as soon as possible to establish the resident participation formulation of National Parks in Taiwan. The research takes Yangmingshan National Park as an example and has the following findings: I.Strategic formulation for the administrative organization: (1) Establishing national parks by law is an important construction plan of our country. (2) The administrative strategies of national parks will directly and continuously influence the right of the park residents (3) New administrative strategies are made by law and the mechanism of participation is adopted to change traditional ones. (4) The current executive ways include notification, information disclosure, consultation, and participation, etc. (5) The consulting system for the park residents is insufficient. (6) We have to accelerate legislation and the establishment of administrative procedure. II.The orientation of the park residents and relevant organizations: (1) The main goal is having the residents participate to maintain their right. (2) The external environmental factor will affect the residents’ will to participate. (3)The critical argument for national park management is the appeal to environmental justice of the residents. (4) The park residents are inclined to perceive the administrative strategies about national parks in a negative way, which obstructs the governmental implement. (5) The main aspect that the residents participate in national park management is mediation and negotiation (6) Other than the residents, non-governmental associations are also important participants in the national park management. III.The Interaction between the Administrative Organization and the Park Residents: (1) The main disagreement of the national park management between the administrative organization and the park residents is the phenomenon of “not in my backyard”. (2) The contradiction between the mission of the organization and the residents’ requests may cause management dilemma and policy deadlock. Based on the finding from the above research, we come up with some specific suggestions like organizing the interactive mechanism between the administrative organization and the park residents and building up the participation system for park residents, which can be the strategic tools for conflict management of environmental strategy. We expect to reach the goal in covering both conservation mission and the sustainability of participation reciprocity in the national parks together.
