民眾參與規劃審議之探討-以中科四期為例

摘要

近年來不少國家重大建設計畫案，面臨到民眾上街抗爭的情形，中科四期就是其中一個重要的案例，中科四期在計畫審議過程，居民多次前往審議機關陳情與抗議，計畫審議通過後，民間社會仍強烈反彈，後續甚至出現行政爭訟，體制外的抗爭，顯示了現行的審議體制在民眾參與上出現問題。
本研究主要從理論與中科四期的個案，進行民眾參與規劃審議之探討；理論部分主要分三部分，分別是規劃理論、民眾參與理論以及權力三面向，透過理論回顧建構視角，進行現行制度與個案之分析。
民眾參與是公共利益的表徵，在民主的國家，政府理應響應民眾參與；民眾參與的概念相當廣泛，本研究在理論回顧下，將民眾參與定義為，「民眾基於自由意志，自發性地透過公共對話與適當機制，就政策方案表達意見，進而影響公共政策形成。」，並以上述定義為基礎，就個案與制度進行分析。
研究發現，現行制度的設計，民眾參與存在多重制度障礙，而且缺乏權利保障；在個案分析中，研究結果顯示，現行的審議制度，並非以民眾做為主體，在專家與技術主義影響下，民眾僅是形式上的參與規劃審議；不民主的制度設計，剝奪了民眾應有的權利，更提供了政治力操弄的空間。
綜言之，在參與程度不高、缺乏權利保障以及充滿制度障礙下，現行的參與制度充滿諸多的不合理；民眾參與在理論與實際上存在落差。

In democratic countries, Public participation is means to the public interest , therefore which government should response to public participation, This reasarch reviews of planning theory, citizen Participation theory and the three dimensions of power , base on the reasarch review, This reseasarch give a definite of Citizen Participation. Analyse of current system and the case of Central Taiwan Industrial Science Park’s (CTSP)
The result of this research shows that Citizen Participation have lots of system barrier, lack of Protection of the rights, citizen participation are not main part in current planning system. Under the influence of rationalism, type of participation is just tokenism. Undemocratic system design, what is not only deprived the rights of the people, but also Provide room for political manipulation.
In brief, this study has shown that System of plainng deliberation is full of many unreasonable. Public participation is being the gap between theory and practice.
