在現代法治國家中,隨著人民需求之日漸倍增,國家所需處理之行政任務類型亦趨於多樣化,因此單一行政機關處理單一事務之可能性可說是殊難想像,因應此一趨勢,相關法制的設計上便形成所謂多機關、多程序、多處分的集合現象,而在此同時,多階段行政程序此一新興之概念便順應而生。然而此一概念與實務案例上常出現的多階段行政處分,是否存在一定之差異性,仍有待深入之研究。本文擬從多階段行政程序之概念作出發,探討其與多階段行政處分在意義、類型與功能上的差異,並企圖找出兩者之共通要素以及區別之重點,同時以此概念檢視我國環境影響評估審查結論與開發行為許可間在法制變革過程中所呈現之程序架構態樣,並且藉由比較美日德三國在環境影響評估法制上之建置模式,以及中科三期環評案中所引發之相關爭議,檢討現行環境影響評估法制所產生之若干盲點,最後企圖從外國環評法制之比較研究中,找出我國環評程序得以作為借鏡之處,希冀能形塑出屬於我國環境影響評估法之應有的面貌。
Under rule of law, the state missions with the increasing needs of people become diverse. It cannot be imaged that one agency deals with one single affair at one time. In light of this situation, the phenomenon of multi-agencies, multi-process and multi-dispositions must incorporate in the legal scheme. In the meanwhile, a new concept of “multi-stages administrative procedure” is emerged. However, what is the difference between “multi-stages administrative procedure” and “multi-stages disposition” is remain unclear and more advance research is expected. This essay focuses on the concept of “multi-stages administrative procedure”, and tries to analyze the difference between “multi-stages administrative procedure” and “multi-stages disposition” with respect to the definition, function and type. Secondly, this essay takes this concept to examine the procedure framework between the Environmental Impact Assessment Reviews and Planning Permission in order to propose the reform of Environmental Impact Assessment Law by comparing the legal framework with the United States, Japan and Germany. Finally, with the discussion about the issues arose from the Third-Stage Construction of the Central Taiwan Science Park case and the comparison with foreign legal system, a better resolution to revise the Environmental Impact Assessment Law would be anticipated.
