都市更新容積獎勵制度對公益設施提供之效果─以台北市為例

摘要


本研究聚焦於台北市都市更新容積獎勵運作多年後,所提供的實體公益性獎勵之效果,運用公私協力、誘因理論內涵與政府失靈等概念分析目前都市更新制度中,藉容積獎勵作為誘因吸引私部門投入之方式是否能有效提供公益設施,找出所存在的課題,並提供法理面與執行面的相關建議。以台北市為例,以法規政策與公私部門行為為中心,整理現行都市更新容積獎勵相關規定,並整理容積獎勵制度開始施行以來的相關統計數據,找出法規方面的問題及私部門申請獎勵概況及偏好並加以分析,再實地觀察台北市都市更新案例所提供之公益設施是否具公益性,藉由專家訪談及資料蒐集了解個案事業計畫實際運作情形,找出申請項目有所偏好的實際原因,歸納整理出於公私部門合作之下,公益設施的提供與實際操作所面臨的問題及問題的形成原因,分析誘因是否能有效促進公益設施的提供,並提出適當的解決對策。 研究結果發現,多數公益設施項目極少藉都市更新容積獎勵提供;觀察所提供各公益設施項目之公益性,其中停車獎勵公益性受質疑;公私部門目標行為與公共利益之落差導致無法有效提供公益設施;法規政策不周全將影響執行背後之交易成本與私部門之獎勵項目選擇。種種現象顯示運用容積獎勵作誘因的機制運作出現許多問題,建議獎勵額度須做調整,詳細規定捐贈公益設施(△F4-1)流程,涉及都市計畫變更時,事業計畫與都市計畫同步審議公告實施,對都市更新所提供之公益設施做整體的策略引導,加強監督公益設施之運作。

The study focuses on the improvement of public facilities supply under urban renewal floor area incentive in Taipei City. The study will review the theory about Public-Private Partnerships, Incentive Theory, and Government Failure to see the result of urban renewal floor area incentive in promoting urban renewal’s investment and its effects on providing facilities for public use or on physical environment improvement. Take the regulations, policies, and the behavior of public and private sectors in Taipei City as center, the study sorts out the current provisions and statistical data of the urban renewal floor area incentive in Taipei City. Identify the regulatory issues and analyze the profiles of rewards apply of private sector preferences. In case study, choice three cases to observe the Taipei urban renewal case to see whether the public facilities provide public welfare or not. Then find out the actual operation and find out the reasons of the private sector’s preference of the urban renewal project cases by expert interviews and data collection. The last, analyze incentives can effectively promote the provision of public facilities or not, and propose appropriate countermeasures. The results show that most public facilities projects are rarely provided by urban renewal floor area incentive. Observation to provide the public welfare of the public facilities projects, the public welfare of parking award is being questioned. The gap between the target behavior of public and private sectors and the public interest lead to inefficient provision of public facilities. Inadequate regulations and policies will affect the transaction costs behind the implementation and incentives project selection of the private sector. Recommend that the award quota shall be adjusted, formulate the process of public facilities donation(△F4-1) in detail, adopt a strategy to guide public facilities supply under urban renewal overly, and strengthen the supervision of the operation of public facilities.
