我國工會組織與運作–某企業工會個案研究

摘要


我國目前大中小民營企業有幾萬家之多,企業內部真正有成立工會僅889家,所以一般企業工會之會員對於工會的運作及功能並不十分了解。而個案公司企業工會的會員對於個案工會的運作,多數人都不清楚,不了解,只知工會是在幫他們爭取福利、辦旅遊而已,並完全不知道工會的功能是在維護勞工的基本權益以及勞動條件。依我國《工會法》的組織章程,工會的功能是維護勞工基本權益的組織。可是法令歸法令,在目前的現實體制中,我國的勞動市場,永遠是資方的市場,勞方團體永遠無法取得勞資互信平等的地位。難怪企業內的資方永遠看不到工會的影子,永遠聽不到工會的聲音。導致企業內部的勞工,一直認為工會是虛擬的工會,沒有什麼功能。 本研究發現個案公司一般勞工一直認為工會是虛擬的,沒有什麼功能。為什麼本研究之個案企業工會沒有執行《工會法》所賦予的宗旨與任務?而全體的工會幹部又沒有堅持工會應如何執行的立場及態度?做為本研究主要選項的研究目的之一。首先是了解個案公司企業工會內部幹部的運作及運作過程中對勞工的影響因素為何?透過文獻的探討,建立一套研究理論基礎,以及用質性的參與方式觀察個案企業體系文化,並用深入訪談的實證分析,真正的了解個案企業內部之廠場工會幹部的運作,期許日後有心想了解傳統產業企業內部的勞工對工會運作的模式,有更實質的意義及功效。

There are thousands of medium and small private enterprises in Taiwan, and only 889 of them set up labour unions. Therefore, most of the members in the labour unions are still not very familiar with the operation and the function of the labour unions. Most of the members of the labour union in the case company are not very clear and fully understand how an labour union should be operated. Meanwhile, the employees in the case company misunderstand that the labour union is just an organization to help them to speak up for the benefits and organize company tour, but they have never known that the main function of the labour union should be protecting their working right and working condition. According to Taiwan Labour Union law, the labour union is an organization to protect the minimum working right to the labour. However, in the reality, Taiwanese labour market has become an employers’ market where the labour groups will never be able to obtain a fair and a trusted place. No wonder, inside the enterprises, the employers can never see the labour unions and hear their voice. It has made the employees inside the enterprises thought that the labour unions in their company have never existed and have no functions. This study has found that the general employees in the case company have always thought that the labour union in the company is virtually existed with no functions at all. Why the labour union in the case company did not practice the goal and the mission authorized by Taiwanese Labour Union Law? Why the whole managerial members in the labour union of the case company did not hold the position and attitude of how the labour union should be run? There are the two main discussion topics of this study. First of all, it is important to understand how operation process which is functioned by the managerial members of the labour union in the case company affects the employees? Following with the reference study, it is to build a general method to observe the company culture of the case company. Through analyzing further interviews, it is to fully understand how the managerial members in the labour union of the case company operated their union. It is to hope that this study can provide a practical and effective module for the employees who work in the traditional industry to understand how to operate a labour union
