引進大陸船員機制與對國家安全影響之研究

經濟全球化的時代裡，「降低人事成本」與「有效彈性運用人力」因而成為許多單位需求，漁業為臺灣重要產業之ㄧ，漁業面臨勞動力嚴重缺乏的問題，臺灣漁船聘僱外籍與大陸船員遂成為解決船員勞動力不足的重要手段。引進大陸船員之法律規範並未盡完善，衍生人身安全、衛生、港口觀瞻、人道及國防安全等相關問題。大陸船員進港安置後，脫逃、鬥毆、海上喋血等危安事件瀕傳，不法事件不斷重演發生，嚴重影響社會治安，也形成國家安全上之一大漏洞，本文即就現行臺灣地區漁業僱用大陸船員所衍生之相關問題分析討論，檢討現行相關政策法令在適用上之缺失，期能就學理上的探討，作為實務運作中參考之方向。我國現行政策及法令規定尚未准許大陸人士進入臺灣地區工作，但大陸船員在我國漁船工作，進入各漁港安置，甚而岸置處所居住休息，已實質進到我國境內，但由於各法令規範不健全，大陸船員生活缺乏長期的照顧與有效管理產生國家安全隱憂，探討之重點先就我國引進大陸船員機制、法規、現行管理作法及缺失，再以相關僱用大陸船員問題對於我國國家安全之威脅研究，依政策分析問題、傳統國家安全方面、非傳統國家安全方面等為研究方向，在依研究結論提出建議事項。
