國小教師Remix教學合法性策略之研究

摘要


面對數位重混學習浪潮,丟掉課本、黑板的數位學習革命已經發生,現今教育主政機構,除應確保第一線有形資源建設外,協助師生建構智財知能以善用數位科技進行有意義之「重混」(Remix)教學進而使孩童學得更多、更好將亦顯重要。鑒於捍衛前世代建立之著作權制度而讓下一世代擔負罪名代價已太高,因此本研究期盼建構簡易「國小教師自我檢核指標」連結並弭平第一線國小教師實務行為與法院實務判決心證間之落差,因第一線教師面對權利所有人的不確定威脅,不僅使學校失能,更因使學校規避培養自身及為孩童發展此能力之重要義務。 綜上所述,本研究首將國小現行教育場域之重混教學活動與行為態樣,如「學習共同體」與「Scorm教材標準規範」之行為態樣進行彙整;其次,依法院對國內教育相關個案之實務判決,參酌相關文獻進行判決文本之詮釋及心證彙整,並依此提出國小教師自評檢核指標之具體架構與相對應指標。其三,簡述創用CC制度前世與今生、現況發展與可能困境。最後,針對主管機關提出應「依規範對象遵守法律機率大小」逐步思考建構相關配套,如開放教育資源推動或教育著作權人團體等制度具體建議。

The goal of copyright law is not only for the individual interest but also for the public interest. Public interest in copyright law can be regarded as the collective interest of copyright users. Although the law of protecting teachers can be found in most of the copyright statutes. This is partly because the lawmakers of contemporary copyright chose to define the copyright scope for the author, and then preserve the public interests as limitations, defenses, or exceptions to copyright. In recent years, elementary school teachers’ teaching environments have been furthered sacrificed because of the advance of digital technology and the increasingly remix e-learning limited posed by the copyright law . Therefore, it is time to help teachers identify the court suit and their e-teaching behaviors in copyright system. This article first draws the relationship between remix teaching and the goal of copyright law, and then explores how copyright statutes cope with elementary school teachers and their behaviors. Different types of elementary school teachers remix behaviors in copyright regime are analyzed as well. This article argues that elementary school teachers’ behaviors have important social value that is closely related with the legislative goal of copyright. Finally, using Self checklist measures and fair use as examples ,this article illustrates how considering teachers will affect the result of copyright policymaking and court decisions. The aim of this articles is not only to build a Self checklist for teachers, but also to urge government to put more emphasis on teachers’ teaching rescources.
