論資料探勘之著作權議題

摘要
　　大數據時代的來臨，使得資料的運用上顯得日益重要，能將資料背後所隱含的價值展露出的資料探勘行為亦逐漸受到重視。而資料探勘的興起帶動了社會的進步，卻也因其中涉及諸多的著作權法上議題而引發爭議，雖然我國對於資料探勘的立法尚處於討論階段，但近年來世界各國已有針對此項議題進行相關的立法程序。本文先論述資料探勘的定義、步驟、應用和與一般統計方法及資料檢索之比較，接續說明資料探勘行為所牽涉的著作權法上權利與侵害，並檢視諸如國際條約、歐盟、英國、愛爾蘭、法國、美國與日本對於資料探勘的立法態度，輔以我國規範現狀與現有之修正草案，點出實有予以立法之必要，最後針對資料探勘所涉及之議題提出本文見解，以期能對我國未來立法有些許助益。

Abstract
　　The new era of big data makes management of information an important issue in every field. Data mining, especially, gets more attention than ever because it serves as a valuable tool for collecting and analyzing information nowadays. The rise of data mining not only drives social progress, but causes copyright-related controversies. Although legislation on data mining is still in the discussion stage in Taiwan, many countries has made it under the legislative progress.
　　This thesis will firstly begin with the definition, steps, and application of data mining. The thesis will further make a comparative study on data mining, regular statistical methods, and data retrieval. The thesis will also introduce possible copyrights and forms of infringement related to acts of data mining. Following the comparative observation on the legislative attitudes of international treaties, the European Union, the United Kingdom, Ireland, France, the United States and Japan toward data mining in the following part of the thesis, the related law and amended drafts in Taiwan will be examined. In the end, the viewpoints and suggestions of this thesis will be provided. Hopefully the finding of this thesis will contribute related legislation in Taiwan in the future.
