從問題建構探討兩岸跨境犯罪：以電信詐欺為例

摘要

臺海兩岸於2009年簽署「海峽兩岸共同打擊犯罪及司法互助協議」，不僅是兩岸司法互助的一大突破，更是兩岸共同打擊犯罪的重要依據，但礙於政治因素、法律制度及高層風向不定等因素，造成雙方無法充分合作，使得兩岸在共同打擊犯罪僅限於個案合作，而非制度化解決問題。
隨著兩岸交流日趨頻繁，帶來人民往來之便利，卻衍生出如毒品、人蛇偷渡、非法槍械、走私、詐欺、洗錢、經濟犯罪及組織犯罪等非傳統安全問題，對我社會安全影響甚深，其中尤以電信詐欺犯罪，牽涉層面甚廣，被害人數最多，破壞金融體系，影響經濟秩序，對國家社會造成鉅大的損害。目前兩岸在合作打擊跨境犯罪上，不論在法律面、偵查面及實際面，仍面臨許多問題，有待藉由政治協商、修法或利用其他方式解決，本文即希望藉由研究、分析，進而探討兩岸跨境電信詐欺犯罪問題真正的本質，藉以改善現況。

Across the Taiwan Strait, signed in 2009, "cross-strait common fight against crime and mutual legal assistance agreement" is not only a major breakthrough in cross-strait mutual legal assistance, but also an important basis for cross-strait common fight against crime. Due to political factors, the legal system and high-level wind direction uncertain and other factors, the two sides are unable to cooperate fully, so that cross-strait cooperation fight against crime is limited to certain cases rather than institutionalized.
As cross-strait mutual exchanges become more frequent, Bring convenience to contacts between people leading to such drugs, smuggling, illegal immigrants, illegal firearms, fraud, money laundering, economic crime and organized crime and other non-traditional security issues, having a deep impact on social security, especially in telecommunications fraud crime, involving a wide level, the largest number of victims, the destruction of the financial system, the impact of the economic order and had to enormous damages to country and society. On cross-strait cooperation in fighting against cross-border crime, regardless of the legal side, the detection side and reality side, still faces many problems which are negotiated by political, amendment of the law or use other means to solve. This paper is to hope research, analyze, and then discuss both sides of cross-border telecommunication fraud crime true nature, in order to improve the situation.
