臺灣地區偷渡犯罪現況與政策之探究

摘要

海巡署自2008年後於臺灣各海域及岸際陸續緝獲多起越南籍偷渡案件，對於臺灣地區國家安全、經濟及治安等各方面無非是造成莫大之威脅，尤其是這些年來越南籍人士偷渡的現象是目前社會存在的問題，也是屬於全球性問題，尤其隨著全球化的發展，使得國與國之間經貿相互依賴性提高，所以也造就了偷渡案件的發展條件。偷渡的行為會觸及各國的安全問題，例如造成輸入國政府無法對偷渡人口掌握行蹤而衍生出治安問題或偷渡集團利用偷渡人口進行不人道的販賣行為，進而衍生侵害人權的情事，本研究係藉由臺灣境內查獲的越南偷渡犯罪模式、態樣分析及現行政策實施檢視，以作為將來防制偷渡案件的應因之道。
在研究方法上，本研究採取的是質性研究現象學的研究方法，選定 9 位在海巡署實際從事防制偷渡工作人員為訪談對象，以半結構式的訪談方式進行，在資料分析上採取論述分析方法，將訪談所得資料進行整理、分析。本研究旨在發現臺灣地區偷渡犯罪方式演變及渠等來臺後所從事之行為可能衍生的社會問題，並自現行防制非法入境之政策及相關法令實施探究，並就偷渡犯罪所面臨的現況、面臨困境與外籍勞工政策、防制作為提出嚴峻國内相關法令、強化國際司法合作、重視外籍勞工政策、加強情報蒐集力度及完備科技監偵工作等提出5項建議。

After 2008, the Vietnamese illegal immigrant cases that Coast Guard Administration seized in Taiwan coast, are nothing more than the great threat to national security,economics and public order. Especially, the Vietnamese illegal immigrant’s phenomenon is not only the current social issue but also the global one. With the globalization, the relations between countries are more economic interdependent, which facilitate the illegal immigration. Illegal immigration issue threatens and impacts on the national security, as the undocumented immigration may intimidate the social order or become the victims of human trafficking. According to the mode of illegal Vietnamese immigrants’ behavior, scenarios analysis and current policy.The researchis in order to provide a prevention of Vietnamese illegal immigrants.
The research method engages in qualitative research method and 9 cases are interviewed to reveal their opinions on preventing illegal immigrant. The collected data were arranged and analyzed by discourse analysis. The purposes of this research were to find the future trend about the mode of Vietnamese illegal immigrants and probably social question. Discussing with current stowaway preventive policy and law of illegal immigrant. Finally, I propose five recommendations about the status of policy, prevention, as a references to help government revising the law.
