從專利及品種權探討台灣植物種苗產業技術發展

Technological Trajectories of Seedlings Industry in Taiwan: An Analysis of Patents and Plant Variety Rights

摘要


近年來隨著農業生技產業的崛起,使得長久被忽視的植物種苗產業又再次為人所關注。但我國植物種苗產業之技術發展現況及其未來展望為何?迄今仍較缺乏相關系統性之研究。基此本研究選定最具創新代表性的專利及品種權資料庫進行分析,探討該產業之技術研究發展現況並提出建議。本研究透過農學專家協助進行專利資料的檢索與篩選,以台灣經濟部智慧財產局專利資料庫及行政院農委會植物品種權公告查詢系統為檢索對象,檢索期間涵蓋2008年2月以前所有資料,計獲得育種、繁殖相關技術之有效專利410筆,品種權676筆。研究結果顯示:1.從專利分析看,台灣植物種苗產業育種技術,以植物組織/細胞培養之專利申請件數最多,且早在1972年便已有該技術之專利申請;反觀重組技術發展則相對較晚,但發展至今專利申請僅次於植物組織/細胞培養技術。2.在繁殖技術方面,則以有性繁殖技術申請最多,早在1965年便已有該技術之專利申請紀錄,且穩定發展至今已逐漸朝向農機、農化等週邊領域發展。3.蔬菜及花卉類作物為台灣植物品種權申請之大宗,且以民營種苗業者申請為主,唯蔬菜之權利維護意願明顯較花卉類作物低。

In recent years, the bio-technology industry is becoming more and more important. That is making much interested in the industry of seedlings in Taiwan, but seldom in academia. The research related to the seedlings industry are neglect up to date. Thus, the purpose of the research tries to make some contributions for the industry. We analyze the database of patents and plant variety rights to explore the technological trajectories of the industry of seedlings in Taiwan. Thus, relying on the assistance of experts we analyzed 410 patents and 676 Plant Variety Rights before February of 2008. The results show that:1. After the analysis of patents of breeding, the techniques of tissue culture are most crucial for present development in the industry of seedlings in Taiwan. They developed from 1972. However, the development of gene recombination technology is later oppositely, but the application of patents is more and more important. 2. After the analysis of patents of propagation, the techniques of sexual propagation are most crucial for present development in the industry of seedlings in Taiwan. They developed from 1965. Until now, they develop to the field of agricultural machinery and agricultural chemical. 3. After the analysis of plant variety rights, majority permissions in vegetable and flower section. The application of plant variety rights is led by private enterprises, but the maintain intention of plant variety rights of vegetable section is lower than the flower section.
