台灣與美國急診轉診相關法規之探討

摘要

本文主要在探討與比較美國和台灣對於急診病患轉診的法規，可發現美國對於病患轉診已訂定出相當縝密的規範，對於違反其規範者定有嚴格的罰則，法院亦有相當多的判例可參考，急診醫師對於法規亦具有良好的遵從性；反觀國內現行急診轉診的相關法規仍處於宣示性大於實質性的狀態，本文提出七項建議，若能盡快克服各項困難修法並依法施行，急診轉診之醫療品質當可更為提昇，病患之權益亦可獲得保障。

In this paper we compared emergency transfer laws and regulations between the United States and Taiwan. Laws and regulations in the United States are well established. They also have deliberate forfeits for violations with many legal precedents for reference. Emergency physicians are compliant with these laws and regulations. On the other hand, Taiwan’s laws and regulations for emergency transfer are still in the announcement stage. This paper suggests seven recommendations to resolve these problems. If we can overcome those difficulties and implement emergency transfer laws and regulations, the quality of emergency transfer will be much improved.
