摘要

女性主義犯罪學始於研究者持所謂的女性主義觀點，或是以女性主義的研究進路，針對主流犯罪學女性犯罪人之忽視，或是女性形象之扭曲提出質疑與批判。從一開始既有理論的性別漏洞之填補，而今逐漸建構出女性主義者本身之犯罪學理論。當相關研究已累積一定之成果後，女性主義犯罪學者亦開始自後設的立場，反省自身學術建構認識論上的問題。本文昌在對西方女性主義犯罪學之發展過程做一文獻回顧式之概觀。除了說明女性主義犯罪學發展所存之社會與學術脈絡外，並對理論本身之發展做一歷史性的瀏覽。而後以後設之立場，依Harding之認識論之分類，將女性主義犯罪學研究分女性主義經驗論者、被壓迫者觀點之女性主義與後現代女性主義犯罪學。最後檢視女性犯罪學所受到來自主流犯罪學與女性主義學者本身之批評，並對於女性主義犯罪學之發展提出建議。

Feminist Criminology burgeoned with where researchers criticized the neglect of female criminals or the distorted image of women in mainstream criminology with so-called feminist perspectives or approaches. The theory keeps on developing from adding to the shortcoming of women study in existing theories, uncovering the gendered character in criminal institution, to devoting to its own theory-building. This article aims at reviewing the literature development of Western Feminist Criminology. In addition to outlining the social background and academic context, the researcher intends to trace the theory historically, correspond to its epistemology, and explain with three groups, that is, Feminist Empiricism, Standpoint Feminism and Feminist Postmodernism comparatively. At last, the researcher ends up with the presentation of all the critiques from both positive and negative sides and makes comments to their disputes.
