本土性的復歸式正義“和解”經驗建構：探索性的文本分析研究

摘要

復歸式正義(restorative justice)自1970年代以後，成為西方在刑事司法與犯罪學界的重要課題。復歸式正義是一種「關係式正義」，認為處理日常衝突問題的重點在於尋求被害者、加害者及社區三方面關係的修復。目前該理論正迅速在澳洲、紐西蘭、北美洲、歐洲與日本等國發展，其實務的發展類型主要有：被害者－加害者調解、家庭團體會議、審判圈、社區修復委員會等四種。理論的核心主張為：和解、承擔責任、道歉與補償。西方在進行復歸式正義的實務性和解為實踐理念的第一步，成功的「和解」條件須建立在社會的信任關係。本研究採立意抽樣方法，針對新竹地區人士進行半結構式問卷，並以質性研究的文本分析(text analysis)方法共分析三十二份文本。研究發現，本土的「和解」經驗著重「賠償」的結果，而缺少議題的討論空間。再加上調解人員的專業背景良莠不齊，是導致本土的「和解」：重量不重質。至於討論未來是否向西方「復歸式正義」看齊時，研究也發現，改善現行司法不公正的情形與學校教育納入「寬恕」的道德教育是受訪者認為首重的課題。

Restorative justice which is a ”relational justice” has become an important topic of the Western criminal justice and criminology since 1970.It had used to solve everyday disputes and try to search repairing for interaction of the three relational dimension: offender, victim and community. At the same time, it has spread out rapidly in Australia, New Zealand, North America, Europe, Japan and included four typical programs: victim-offender mediation, family group conferencing, sentencing circles, community reparative boards. The important emphasis on restorative justice is: mediation, accountability, making amends and restoration. The purpose of this study was to understand 32 persons' viewpoint about mediation of everyday disputes. Based on text analysis, we try to construct and reveal several meanings from the local mediation experience.
Finally, this study will be provided the suggestion if restorative justice is carried out in Taiwan.
