從方案評估理論反思《都市更新條例》

The Reflection of ＂Urban Renewal Act＂: From the Perspective of Program Evaluation Theory

摘要

本文應用方案評估角度重新審視《都市更新條例》的機制與可能盲點，發現《都市更新條例》的誘因機制雖然有效，但在成效評估與執行者能力的配置上較為不足，以致出現都更案分佈失衡、主管機關審核速度緩慢等問題。修正案雖試圖納入社會公平的精神，提高民眾權益保障，但此修正案與法案原本的立法目的與整體邏輯並不一致，反而可能使得往後都更案更加窒礙難行。透過都市更新典範的調整、多元實施者的納入、衝突化解機制的設計、未來環境的因應等課題，都是我國規劃前瞻性都市更新政策所必須審慎因應的重要課題。本文一方面可填補公共行政領域在都市更新議題上的缺口，另一方面也可透過理論提供較具全觀性的初步評估，以作為思索未來修法方向的建議。

This article applied program evaluation theory to assess the mechanism and possible blind spot of ＂Urban Renewal Act＂. This research finds that the incentive mechanism of ＂Urban Renewal Act＂ is effective, but the lack of outcome evaluation institution and empowerment of implementors leading to the problems of disequibilium of urban renewal areas and slowness of administrative operation procedural. And the amendment of ＂Urban Renewal Act＂ strengthened the protection of resident's right and social justice, but raises the difficulty of urban renewal. This article suggested a proactive ＂Urban Renewal Act＂ Amendment must include the introduction of new urban renewal paradigm, permits of multiple urban renewal implementors, conflict resolution mechanism and environmental protection issues. The aim of the article is to fill the gap between public administration study and urban renewal issue and to provide suggestions of ＂Urban Renewal Act＂ revise based on the evaluation.
