德治與法治的時空交錯中國法治社會形成過程中的蔣中正法律思想

摘要

中國國民黨的統治，是中國的第一個黨治時期，儘管如此，卻自此建立起一具有現代法治意義的法律體系，而於日後爲台灣繼受並有效施行至今，本文所想要呈現並討論的是，在當時的歷史背景下，中國傳統法律文化基本價值中的德治觀對於國民黨建立現代法治的影響。本文試以當時中國的強人領袖蔣中正的法律思想爲中心，對此一問題進行探討，並期待得提供當前中國第二個黨治時期的法治建設前代歷史經驗對話的基礎。

Kuomingtang's Governance is the first rule by party in China. At any rate, it had built a modern legal system which was succeeded in Taiwan up to now What we want to discuss is how the idea of the rule of virtue of the Chinese traditional cultural value effect Kuomingtang to erect the modern rule of law state This article focuses mainly on Chiang Kai-Shek's thought of law and governance and anticipates to provide a dialogue between the two Chinese party-states in the contemporary mainland China.
