兩大法系的「無縫對接」:魁北克高等法學教育探微-以麥吉爾大學及蒙特婁大學的「跨法系」學位制度為例

The Intergration of two Law Traditions: A study of Legal Education in Quebec

摘要


法律教育與法律實踐緊密相連。魁北克處於歐陸法系與英美法系交叉的混合法域,其法律教育也體現出了交融的色彩,比如其境內的麥吉爾大學及蒙特宴大學都推出了「跨法系」學位制度:前者通過4-5年的時間學習獲得英美法和歐陸法兩個學位;後者通過前三年的學習獲得歐陸法學位,之後可以選擇一年時間再獲得一個英美法學位。二者的定位、要求、培養方法等都不間,但是兩種學制都應對實踐,凸顯了法學教育職業化的取向。

The legal education and legal practice are intergrated closely. In a mixed jurisdiction such as Quebec, legal education also reflects mixed characteristic, 1 ike two major universities in Quebec: McGill University offers the combined B. C. L. /LL.B. program, leading to law degrees in civil law and common law studies which will take 4-5 years; the University of Montreal offers 1 year North American Common Law (JD) program, which is add on 3 years civil law studies. The orientation, requirement and trainning method of these two programs are all different, but they both reply the legal practice and highlight the tropism of professionalization of legal education.
