摘要

在刑事司法的流程裡，對於犯罪的抗制，由於政府較重視前階段之偵查與審判，對於監獄與觀護制度甚至更生保護則較少宣導，因此國人對於假釋制度的了解非常有限，甚至普遍不足，除非發生像八十五年間「白曉燕被陳進興等人撕票案件」，社會才會對假釋犯大加撻伐；惟在大肆批判，交相指責後，又如雲淡風輕般地復歸於平靜。因此，本篇論文，希望能以筆者多年來在監獄及成年觀護之實務經驗，對假釋制度之法律問題提出檢討及建議，讓人民對於「監獄風雲」之錯誤認知有所改變，也讓一些想痛改前非之假釋犯，透過正當法律程序，以保障其「限制自由」，並能得到社會的認同；相反地，對於無真心悔悟之假釋犯，可透過假釋要件之實質審查的機制，以篩選一些為拿分數而虛情假意之人，避免其出監又再度危害社會；即使出監也能透過觀護處遇之嚴格監督，讓其早日回籠，以保障民眾人身及財產的安全，落實假釋制度之良法美意。

In the procedure of the criminal administration of justice, to make the resisting of the crime, the government pays more attention to the investigation and trial in the front stage but less propagates the knowledge about the prison, probation system and even regeneration and protection, so we compatriots are extremely limited in understanding to the parole system, and even generally insufficient for it. Only if it occurs like the case of ”Hsiaoan Bai was killed by Chinsing Chen et al.” in 1996, the society will criticize the parolees severely. After being criticized, however, the matter will thoroughly be forgotten and seems nothing happened Therefore, on this thesis, I, who has much practical experience from working for years in the prison and grown-up probation, offer some suggestions on the legal matters of parole system to let our people have the correct cognition about the ”Prison On Fire” which is often misunderstood. I also hope those parolees who eager to rectify their errors will ensure their ”limit freedom” and can get the approval of the society by means of the due process of law. On the contrary, for those paroles who are not repentant in sincerity, we can use the mechanism that can be examined through the essence of the conditions of the parole to sieve the hypocrites out and prevent them from endangering the society once again when released from the prison. Even if they are released, they will be withdrawn as soon as possible because of the strict supervision of the probation system. Thus, the security of our people and our property will be guaranteed and the kindness of the parole system will be executed.
