當代比利時憲政體制

摘要

作爲歐陸強權昔日必爭之地，比利時之獨立建國乃該國人民對國家前途自主決定之結果。雖延續歐洲王室傳統，比國當今政府體制充分體現立憲主義核心精神，三權分立國家組織原則使各政府部門權責分明，透過政黨、利益團體、以及選舉等政治參與機制，國民主權精神在此獲得實踐，憲法基本權清單之確立，與實際憲政生活中國家組織爲從事特定作爲或不作爲所恪守之法治國原則，皆爲比國當代憲政體制之實際寫照。族群對立雖複雜化該國政府組織設計，與混淆人民國家認同，然而在此負面憲政經驗背後，卻也體現比國對於多元族群自主發展權利之肯認與尊重。

The contemporary government system of Belgium is established based on the spirits of the constitutionalism. The rights and duties of each government section are clear. Through the political participation mechanism of political party, interests groups and elections, the idea of citizen's sovereignty acquires its implementation. The constitutional guarantee of human rights and the principle of the rule of law are actual portrayal of contemporary political life in Belgium. Although a complicated design of government system and confusion of national identity, recognition and respect of the rights to self-development can be seen vividly in the cotemporary constitutional system of Belgium.
